In the judicial hierarchy,the FHC's decision is superior to that of the NIC...so in my opinion, the NIC does not have the power to override the decision of the FHC

With due respect ma'am, they both have co ordinate jurisdiction. The NIC, by the recent amendment to the Constitution, have powers to sit over criminal matters, including trfficking in persons, arising from labour issues.

The big question here is; why have recourse to the NIC? In my limited opinion, this matter should have come before a High Court in Rivers state and should be commenced by an Originating Summons cos this to me is not a contentious issue. If it is to determine;

1. whether the former Governor of Rivers state has powers to go ahead with the conduct of Local Government elections and inaugurate same in the face of a subsisting Court ruling in the matter.

2. Whether the 90 day rule was observed before notice and conduct of elections.

[b]The AG is just trying to spin this one but he has failed. An incompetent fool that should be sacked by any sane government. No APC lawyer was in court Yesterday yet he failed in his bid.
He approached the Court in Bayelsa asking the court to set aside her earlier judgement in June while parading the High court judgement in court but the NIC refused to do so despite acknowledging that indeed Akanbi made the judgement.
The NIC made no new order neither did she set aside the one she earlier made in June as requested by Aguma the AG. This simply means that the order is still valid and must be respected.
Both the High court and NIC are federal courts with equal powers. Wike cant just agree to obey one and disobey the order. Pending when a superior court (federal appeal court) makes a superior order, the order is valid. The AG should just shut up. He failed in his bid in Beyelsa yesterday and thats the fact.
The elected LG chairmen are expected to resume this morning and i forsee a farcas if those illegal CTC chairmen confront them.[/b]
