Ministerial Screening: Group Secures Court Order To Stop Amaechi - Daily Post by Episteme2(m): 9:25am On Oct 15, 2015
There are very strong indications that Peoples Democratic Party, PDP, working through one Livingstone Wechie, has secured a court order to stop the Senate from screening former Rivers State Governor, Rotimi Amaechi as a ministerial nominee.

Wechie through his organisation, Integrity Group had claimed, that Amaechi corruptly enriched himself while in office as Governor.

Amaechi had denied every of the allegations, describing it as a witch-hunt.

The order, reportedly secured from a Rivers State High Court, is expected to be served on the senate before its sitting, today, Thursday.

A source also hinted that the court papers had already been served on the Senate before the close of work on Wednesday.

Amaechi was initially one of the ten ministerial nominees scheduled to be screened on Wednesday but his screening was deferred as a result of the delay in the report of the Senate’s Ethics and Privileges Committee.

No matter how many tactics Amaechi applies to escape been prosecuted for his wrongdoings in connection with this country's funds, nemesis will eventually catch up with him. If not now, later.
Where are his school children here?

Why a Rivers State High Court and not a Federal High Court which has jurisdiction over the NASS?

Don't get me wrong, I was one of the Petitioners that wrote against Amaechi's Nomination but technically speaking, if i must approach the Court of Law to grant an Interlocutory Injunction against the NASS from insisting on going ahead with the screening in spite of my petition, then I should be advised to approach a FHC in Port Harcourt or Abuja.

An interlocutory injunction is a court order to compel or prevent a party from doing certain acts pending the final determination of the case. It is an order made at an interim stage during the trial, and is usually issued to maintain the status quo until judgment can be made.

The Petitioner can institute a case in the Rivers State High Court and then the FHC can grant an order against the NASS to maintain the status quo until judgment can be made in the State High Court

Another huge joke from the thug, wikes camp.
No court order can stop the senate from doing what she is constitutionally empowered to do. That is their responsibility as recognised by the law of the land. So many precedence exists on this.
It's like u saying u have a court order asking the senate not to pass laws. The worst u can do is after doing what they are empowered to do from our law books, u can go ahead to test it ( law, decisions etc) in the law court.
Senate gonna do what the law asked them to do. Wike has failed again.
Senate, will receive it and junk it. Let wike sue the senate afterwards. grin

The Senate does not go against or encroach the Judiciary! Even the Committee on Ethics respect that fact when Amaechi told them that the case is in court. If there's truly a court injunction, they will gladly respect it(Separation of Powers). That is that on that.

@OP, you need to edit your topic. Your use of "PDP gets an injunction" instead of Livingston is just an assumption that hasn't been verified. Tho we know PDP is behind it all, but still, that heading is wrong.

The legislature won't encroach likewise the judiciary must not encroach. The legislature derives it's powers from the constitution to enact laws and whatever else they're empowered to do. Judiciary asking legislature not to do what they are empowered to do is encroaching. Get this straight.
The Amaechi case in court can't be looked into by the legislature because doing so is encroaching so they are right to have stepped down on this.

Pdp is livingstone while livingstone is pdp. This is a well-known fact. Stop playing smart. grin

well let me waste some few MBs to respond to you.

I'd it were as easy as you just wrote it, Amaechi would have been screened since two days agao. But it has been a tough one for him.

If he doesn't reach out to Wike's men, believe me he will be left stranded in the cold... Just watch

You are wrong. The legislature cannot be injuncted from carrying out its constitutional responsibilities, just like the legislature cannot make laws ousting the jurisdiction of a court which has been vested constitutionally.
An important question is, if the Rivers State govt could go to court to apply for an injunction what stops it from commencing the prosecution of Amaechi if they are sure of their facts?

Wike's comedy has kept Amaechi up and awake for 3 straight days. While others have come and gone waiting to start their noise, untilnow Amaechi does not even know if he will be called at all for screening

Bobo if u think amaechi will be cleared just like that, u r on a long thing.
So far the chairman of that ethical committee is a pdp man and rivers state senator is one of the members in the committee.
Amaechi is playing a silly god and he is so foolish in his thinking. Do u think fayemi just got comfirmation by pdp senators and fayose without meeting them?
Do u think fashola didnt meet with tinubu and clarify issues before he got cleared by those tinubu's senators?
Amaechi shud do the simple needful, go meet this people, its not bad playing the biblical nicodemus, once in a while u need to scratch one's back so urs too can be scratch. Make him dey form kingkong na, wetin consain me with a thief.
And lemme tell u d fact, amaechi will lose it and nigeria and buhari will still be. No jupiter can do otherwise.
Am a pdp and will always be civil.
