kennes10:When they have done what the law asked them to do, if u feel they didnt follow due process in achieving the result such then u will be tested in a law court. A court can declare that a law passed is unconstitutional but not when they are working towards doing their constitutional duties. If after they have acted, u suspect non compliance then u go to court. U cant stop them from acting at all. |

Assuming without conceding that there is a restraining Order issued on the Senate, the Senate will not be arm twisted into abandoning its constitutional duty. It is only a matter of common sense that a state controlled judiciary such as Rivers state judiciary will only dance to the tune of the Governor(Wike). shortgun:We have the Executives, Legislature and Judiciary. These three are suppose to be independent but in reality they arent. They all derive their powers from the constitution and the laws of the land expect them to do such to avoid anarchy. Legislatures are empowered to perform certain function and whether a court likes it or not, it must and will be done because they have the backing of the highest law of the land. E.g, No court can ask or stop legislatures to stop enacting laws because that is their function among other things. If the process of enacting a law or performing a duty they should do is faulty, u as a citizen can go to court and ask the court to nullify that action of theirs. that is different but not to stop them from performing their duty. Its a different ball game entirely. |
