Saraki thought he would extricate justice at the back door without knowing that the federal govt is in total control of the judiciary. Saraki must be jailed for his financial atrocities. |

onatisi:Yes, CCT will have to hold on... because it's jurisdiction and composition was challenged in Appeal Court, which the Appeal Court have entertained and adjourned its judgment on that matter. Therefore, CCT being an inferior court to Appeal Court, MUST wait for the judgment by the Appeal Court. |

FYI the CCT set the trial date for 21-23 and what could have stopped the tribunal entertaining the matter is a judgement at the Appeal Court. Was there any judgement? NO. Saraki in future endeavors will learn to tread with caution especially when you don't have the president in your camp. You don't ridicule your party in such a manner and expect to be forgiven just like that especially as you were given a leeway for restitution with the adoption of the party's nominees for the principal positions. |

ziccoit:What am saying is that you used the word "erring ". A judge cannot be disciplined for erring in his judgment as long as he did not collect any bribe. That's why we have hierarchy of court. Appeal Court is there to correct any erroneous judgment by the lower court, whereas the Supreme court is there to correct any erroneous judgment by the Appeal Court. Errors in judgment is different from involving in any corrupt dealings as a Judge. |

Hmmmm Definitely CCT will still hold, thou Appeal court is a superior court but as a mata of fact there is no judgement yet from Appeal court..at the inception I don't fink Saraki has any reason or right to appeal first..its after the judgement of CCT..then Saraki can now appeal and any judgement given in appeal court wil overule CCT...quote me if am wrong |

Rexology:This is wrong. The Court of Appeal is NOT hearing the same case as the CCT is trying; in other words, the CoA is NOT trying Senator Saraki. The CoA is trying to determine whether Saraki's trial at the CCT can or cannot continue. Big difference. Until the CoA makes a pronouncement on the matter and expressly stops the CCT from continuing with the case, Saraki's trial at the CCT continues. It is de-ja-vu again... Reminds one of some uninformed guys' interpretation of the first pronouncement of the then moribund Federal High Court on essentially the same subject matter. That funny judge eventually eased himself out of the case, while saying his court never at any time stopped Saraki's trial before the CCT, contrary to what some were feeding to the public. @Montaque An appeal does not act as a stay. However, the only requirement for saraki's lawyers to do which I trust they did is to transmit the records to the court of appeal and file an affidavit at the Tribunal. Naturally, the Tribunal will stay proceedings pending the determination of the Appeal. The case at the Tribunal will likely not go on tomorrow |

@Duwudu If you were a lawyer, you would have understood what I wrote. However, let me break it down to you. Normally, when there is a judgment /Ruling from a lower court and a party goes on Appeal, the normal thing is to file a Motion for Stay at the lower court and if refused at the Appellate court. However, if a party quickly compiles and transmit the Records of Appeal, the lower court would automatically stay proceedings to avoid judicial rascality and tongue lashing. The law is that an Appeal should not act as a stay but till Order 4 Rule 10 and 11 of the Court of Appeal Act is Amended which states that once an Appeal has been entered, the lower court lacks jurisdiction to preside over the subject matter of the Appeal, lawyers would capitalize on this. Let's see what happens tomorrow |

From what we read in the news, what happened was that the court was under lock and key,there was no sitting and it was the registrar that inform the parties involved that judgement has been postponed indefinitely.so, this leaves me with the next question that Which record will saraki's lawyer will b transmiting to the tribunal? The one from the registrar or the judgement that was not delivered by a recognised judge today? Please am only asking dis questions from my layman's view and need to be educated.... We learn everyday and i wish to learn more 4rm u sire... |

@snakie86, The court of Appeal only presides on Appeals from a lower court. For there to be an appeal, it means there is a decision (ruling or judgment) that a party isn't satisfied with. In this case, Saraki is challenging the decision of the tribunal to try him. He contested this fact at the lower court before Appealing. Therefore, the Tribunal would wait for the court of Appeal's decision on the interlocutory Appeal |

Who is so afraid of Saraki as SP that they would drag the country's judiciary headlong into shameful illegalities? The bench warrants issued by CCT were illegal, the CCT and the police know this. The Court of Appeal that locked it's doors to justice, and supposedly sent an alleged indefinite adjournment is itself committing an ilegality too. Even the process by which the CCB dragged Saraki to CCT is again an illegality, procedurally. The frightened cabal must have realised in their enclave that the Court of Appeal decision cannot rightly further their evil cause, and brutishly locked the doors of justice. Interesting to see whether Mr anti corruption Buhari will let the enclave of Tinubu, El Rufai and Amaechi destroy his government.
