With the recent deferment of the screening of Rt. Hon Chibuike Amaechi the Lion of the Tribe of Ubima.
The Senate President Bukola Saraki is trying to use him as a bargaining chip, the deal is simple if the Code of Conduct Tribunal drops his case, he will ensure the smooth passage of Amaechi in the red chamber.
However there seems to be limitations posed by the Constitution of the Federal Republic of Nigeria as amended.
Section 147 subsection 6 provides that Amaechi will automatically become a Minister after 21 working days from the day the President sent the letter (30th of September 2015).
Amaechi case seems to be a hard nut to crack.

Modified: with the adjournment of the CCT today to 5th of November 2015, of which the senate must either clear Amaechi or reject his nomination on or before 30th of October 2015 which is exactly 21 working days has put paid to eairler speculations in this post that Saraki and the Senate are cornered by the master chess player.

The portion of the constitution says "where no return is made" The senate would comply and make returns to the presidency by communicating the decision to suspend or postpone his confirmation.

Hmmmmmmm. That is an interesting provision which is open to diverse interpretation. The main problem there for me hinges on the meaning of the word 'return' as used in that subsection. What constitutes a return?

You could argue that the return means a definite statement on whether the nominee has passed the senate screening or failed.

On the other hand you could also argue that a statement from the senate communicated to the President telling him of their decision to stand down the screening of a nominee qualifies as a return. This second Interpretation would however lead to absurdity. It means the senate could step down the ministerial nominee's screening in perpetuity having satisfied the provision of the constitution. Such an interpretation would defeat the intention of the act.

Since the law does not deal in absurdities, then the sensible thing is that a decision on his confirmation must be made one way or the other, otherwise he becomes minister by default.

If Saraki can remain Senate President despite standing trial then there is no ground for them not to screen and confirm Amaechi.

OP I think you have a point but I think they feel that Amaechi won't sail through if screened going by the number of petitions against him so they want to use this means/excuse to get him through without being screened. Of course once the 21 working days elapses then PMB will need no clearance from the senate to make him (Amaechi) a minister.

Who told you that the Senate won't make a pronouncement tomorrow on Amaechi. Saraki won't be around tomorrow and PDP might take their pound of flesh through Ike Ekweremadu.

I see Amaechi having more high BP tomorrow...

Not tomorrow. it is on the 30th of October.
it is 21working days not 21 days.

21working days is aproximately 28days. but in these case, Oct 1 was a public holiday. making it 29 days.

Exactly! Saraki is needlessly trying to pacify some PDP Senators for their continual support. This is what you get when you are not in tandem with your party on internal issues of common interest.
