seunmsg: Wrong analysis there. A deputy never participated in primaries thereby making him ineligible to stand in the run off. Had the election been conclusive then Faleke would have simply mounted the saddle. PDP will oust Faleke legally based on the Taraba case. |

Whether Tinubu is the one that killed Audu or not, the point is that it's unreasonable to transfer the votes of a joint ticket to a third party, especially when the person in question is reputed to have worked and is working against APC and Audu ticket in Kogi state 7 Likes 1 Share |

If APC does not field any candidate then Wada wins. If APC fields Fairplus, then those street urchins called Area boys will have no option than to keep shut. They want to spoil the name of Igalas. How can people say the Igalas are fighting the choice of Yahaya Bello? Just because some few jobless boys blocked road and burnt tyres? It's like saying Yoruba are fighting when some area boys fight at Oshodi. Coming from the royal clan of Igala, I can say with precision that Igalas do not care whether it is Bello or Faleke. Why those boys are pained about Bello is that he fought against Audu's victory. If not we all know both of them have something to prove. felalegend: You really need to understand the Taraba case before referring to it. PDP have no valid candidate in that election. They never participated at all in the election. And please note, winning a primary does not make an aspirant a valid candidate before the law, he must also choose a running mate and both of them must be presented to INEC within a stipulated period before their candidacy can be valid before the law. As regards Kogi, the issue of having a valid primary before the law is to determine the candidate. In this case, Audu is the candidate and that is not in dispute. The law also provides for the candidate to choose his own deputy who will contest jointly with him. Without the deputy, his candidature is invalid irrespective of whether he wins the primary or not. So therefore, whoever he so chooses as his deputy is assumed to have jointly emerged from the primaries with him and will automatically step into his shoes when situations like this arises. That Yahaya Bello participated in the primaries as no legal significance since he was not the winner. Faleke was validly nominated and he should legally step up and inherit the mandate since the election process as commenced already. 7 Likes 2 Shares |

felalegend: By the virtue of being the running mate of Audu, the prerequisite of participating in primaries does not count. The constitution has mandated the person who won the primaries to nominate a running mate. There is a reason the constitution mandated the person to nominate a running mate before his candidacy can be deemed to be valid. A running mate is a spare per adventure anything happens to the principal. The Taraba case you are citing as an example is still before the Appeal Court and may even go to the supreme court for judicial pronouncement, so you cant use that as a justification just yet. Moreover, you are not looking at the core details of that judgment, but just picking the peripheral. One thing you supporters of the 1st runner up in the primaries fail to realize is the constitutional provision I stated above which will be very difficult for the Bello guy to meet. According to the 1999 constitution as amended, the candidacy of a party flagbearer to contest can ONLY be valid if the person nominates a running mate. There is no way the guy can nominate another person for that position, his hands are already tied by circumstances. Although, he may later claim in court that he nominated Faleke after he was pushed forward by the party, but that will be too cosmetic and cannot stand any legal scrutiny as Faleke was already constitutionally nominated by Audu and his nomination to contest as Deputy Governor still subsists and as such, another individual cannot claim he nominated HE whose nomination is still standing and very much valid! 2 Likes |
