Audu was never declared governor-elect by INEC, the only body constitutionally empowered to do so. Thus, Faleke was not yet deputy governor-elect and cannot therefore have any claims to succession.

His position died with Audu.

Should Faleke lose out in his quest thus reconciling himself to being the Deputy Governor, he' s going to be in deep waters as given his posture a priori, Bello will do everything in his power to frustrate his stay in office as he (Faleke) will be seen as an opponent.

Hey! Stop twisting it. The election was inconclusive and Audu wasn't the governor yet. Faleke didn't go through primaries and that will pose a big threat in the future if he is featured; PDP would have taken that as an advantage. Politics na game

Nope! Don't think it applies in the scenario you just painted as the president was a sitting president not an about to be declared winner president.

In such an instance the law clearly stipulates that the vice assumes office in event of the demise or in capacitance of the sitting president.

The Kogi case is totally different. If Audu (rip) had been sworn in before he passed, Faleke would have done a waltz and a jig to the office of the number one citizen of Kogi state. Unfortunately, this wasn't the case.

As i maintained earlier on,APC as a party would have taken advantage of the lacuna in our constitution and assumed that AUdu still lives while INEC goes ahead to conduct the supplementary election and then after the winner is declared,the constitution will now take its course and Faleke will inadvertently be sworn in.

You can not transfer the votes of a joint ticket to a strange candidate because believe it or not,part of the votes counted in favor of APC was accrued to Faleke as a running mate and it is only justifiable for him to be the beneficiary of this?

I am very positive that tribunal will give the seat to Faleke but lets just watch ijn 4d what wil happen,

Wetin concern us? Be your own deputy na. I thought under the situation, INEC and APC did the right thing. That's my opinion. He was a deputy in an inconclusive election. If there was some hanky panky in not concluding the election, we can never know. Too risky transferring to Faleke and there seemed to be no logic in it. In order of possibilities, making Faleke the Governor would be my last choice. My first would be a re-run. And if that was INEC's decision, what would Faleke's response be? APC would have gone with Bello in such a situation.

He was gonna be deputy anyway. Where was he when Bello was second position in the primaries? Why is he so keen on being Governor? This people are not interested in Governance jare.

Pack your load back to Lagos na. I hear you are a naturalised Lagosian. Very unlikely you know what is even going on in Kogi. Bello has been a gentleman and fence builder to even offer you the same position. Make dem dey push you. As it is, based on your resistance, i would suggest Bello thinks twice. You are not interested in the progress of Kogi or its people.

He was a candidate before the election was concluded. He still was a candidate when Bello was brought in. Now he's deputy-elect after INEC declared Bello governor-elect.

Faleke is Deputy Governor Elect, he can only 'inherit' the position of the governor if and only if something happens to the sitting governor WHILE IN OFFICE or AFTER BEING DECLARED WINNER and not before.

Again, some quarters have argued that Faleke didn't go through the primaries, a condition needed to contest as a gubernatorial candidate and as such he lacks the requirement for running for governor given the electoral act.

Another twist to the whole imbroglio is that if Faleke persists in saying he is not Bello's running mate and can prove that he had written to his party in this regard before the supplementary elections had occurred, then even Bello's victory can be annulled as the electoral act makes no provision for an electoral process where a governorship candidate has no deputy.

see...irrespective of what we feel....Bello is d governor. .....I don't like him too but we have to think outside the box.....the result was inconclusive, faleke was never involved in d primaries wch PDP will exploit if Faleke was used instead....The only party at fault is INEC, the result was not inconclusive. ..APC won hands down....except Faleke goes 2 d tribunal, and wins d verdict against INEC dats only when APC can declare him......if not APC have dia hands tied.....Bello is a sly and doesn't deserve it...

Make the guy Siddon for somewhere, when the tribunal he's heading to fall his hand he'll realise he should have accepted the deputy position offer after all the high court have already rejected his case referring him to the tribunal.
As it is now he has one or two options remaining the appeal court and the supreme court.
I have never seen a place where a deputy in an ongoing election is made a winner of the election cos of the disqualification or as the case may be demise of the principal.
Simple interpretation the bane of Nigerian self proclaim elite politicians cos i don't see the appeal court or supreme court giving a different interpretation or decision in this case.
I think Is choice of not being The deputy Is good. Watch out if he accepts it he won't be a deputy governor for more than one year before he Is impeach.so he should stand by his decision firmly
