Court Bars MTN From Moving Funds Abroad by ultrazone(m): 3:13am On Jan 13, 2016
The Federal High Court in Lagos on Tuesday barred MTN Nigeria Communications Limited from moving any funds from all banks in Nigeria abroad pending hearing of its suit challenging the N1.4trillion fine imposed on it by the Nigerian Communication Commission (NCC).

Justice Mohammed Idris ordered parties to maintain status quo.

“An order is hereby made directing the parties cited herein to maintain the status quo ante bellum pending further hearing,” the judge said.

Status quo ante bellum is Latin for “the way things were before.”

In law, it refers to a temporary restraining in which a situation is restored to “the state in which it previously” existed.

The Federal Government had, through a motion ex-parte, sought an order of mareva injunction restraining the 21 commercial banks from releasing any funds belonging to MTN.

It sought “an order of mareva injunction restraining the aforementioned banks from releasing, further releasing any funds, making sale, transfer or payment of any monies or dealing in any manner whatsoever with any and all monies maintained by the plaintiff/respondent (MTN) or its agents, privies, subsidiaries, sister companies or the like in the aforestated banks that will alter, decline or reduce the amount of the first defendant’s/applicant’s fine against the plaintiff/respondent in the sum of N1,040,000,000,000 which has remained wholly unsatisfied, pending the determination of the motion on notice.”

MTN is urging the court to quash the sanction imposed on it by NCC in October last year for failing to disconnect unregistered subscribers.

The initial fine of $5.2billion was reduced by 25 per cent to $3.9billion last December.

But MTN sued NCC and the Attorney-General of the Federation, Abubakar Malami (SAN), contending that NCC being a regulator cannot assume all the functions of the state.

Nobody slammed a fine, it was the agreement signed by all stakeholders before MTN Nigeria disregarded the agreement.
So sad that this happened to MTN Nigeria when they had a Nigerian CEO

If MTN breached an agreement, why can't the FG through the right process tell this xenophobic south Africans to pay the Fine instead of treating the issue with kid gloves, please FG sanction this company ones and for all

If you really understood the rots in our system; you would not type the above. Nigeria is probably only country on the planet where anything goes. Everyone is doing what he likes with total disregard for law, rules and order. What MTN did that attracted the fine would have been enough to ban them from further provision of services and businesses in a saner society. MTN compromised our security and didn't desist despite several warnings. We don't want investors that will not obey their host laws, rules and regulations. Those who would start doing what they dear not in their country.

Man, our security is more important than that and MTN is not better than other networks that obeyed the order. Mtn takes this country for granted

The guy ( mtn CEO) was a former director in NCC. He thought it was still business as usual, forgetting that this administration will not condole impunity. He probably thought he Could muscle his way or bribe a few people and the matter will be swept under the carpet but sorry sir things have changed here Oga CEO .

It was an agreement between this government and all parties involved in the Telecom industry - i think VP osinbajo represented the Federal govt. in view of the security challenge facing the nation. Because it was found out that bokoharam and kidnappers (even armed robbers http://yeyedesmell..com.ng/2013/08/more-startling-revealations-from-armed.html?m=1) make use of this unregistered lines to perpetrate their nefarious activities. The decision to cut all unregistered lines has proven to be the masterstroke in curbing boko haram ability to network and strike.

Sooner than later, they will pay the fine. Infact, I expect NCC to revert back to the initial sum of N1.4tr.
