he judge ruled that Kanu was a threat to national security, and as a result would not be granted bail. He held that if released Kanu might commit the same offence again

I doubt if a judge can make such a submission because Kanu is being charge for a crime (criminal law) and not offence (civil law), but if at all he made such comment he has already disqualified himself on the case for concluding a case he has not tried.
