I was reading through the Nigeria Institute of Science Laboratory Technlogy website and I noticed that graduates of Science Laboratory Technology are allowed to set up private laboratories in which they are licensed to carry out Biology, Microbiology, Serology, Hematology, Histology, Biochemistry, etc tests. They are given their own licenses by the NISLT. My question is are there going to be consequences from AMLS for setting up such a laboratory accredited by NISLT?

National Industrial Court Declares MLSCN Statutory Regulator for Practice of Med Lab Science in Nigeria
Posted: 17/Feb/2016

Justice B Adeumo OFR (President of the National Industrial Court of Nigeria had on 27th January 2016 delivered final judgement in suit No NICN/ABJ/284/2014 Nigerian Union of pharmacists, Medical technologists and professions allied to Medicine and Anor VS. Obafemi Awolowo university teaching hospital complex managment board and 6 others

The suit was transferred to the NICN Abuja from the federal high court on 25th september 2014.

Highlight of the judgements as obtained by a medicalworldnigeria.com correspondent include.

1. The court declared tht the inconsistent provisions of the MDPA are impliedly repealed by the inconsistent provisions of the MLSCNA 2003.

2. On the issue of the teaching hospitals being empowered by section 7 of the university teaching hospitals to deploy staff to appropriate departments and appont heads, the court ruled that the boards cannot post those who are not medical laboratory scientists to do the works of medical laboratory scientists and ipso facto neither can it make any other professional other than a medical laboratory scientist the supervisor of medical laboratory scientists or the head of their department.

If the effect of making medical laboratory science a profession is to make it a distinctive branch of human endeavour, deserving specialized trainings, then the necessary corollary is autonomy of the profession. A profession can only be so called if it has independence of existence and a profession cannot have independence of existence if it  is tied to the apron strings of another profession by means of supervision and authentication of its works which is what pathologists are demanding here. Medical laboratory scientists should have their works supervised and sent directly to the clinicians that requested for their expertise, without the duplicative interpositions of the pathologists.

The argument that medical laboratory scientists were originally mere technicians to assist medical doctors even if it is so,is on no moment now. the law in its wisdom, has decreed that pathology has grown unwieldy because of the share variety of duties dovetailed onto it such that it was necessary to divide it into two by means of specialization and divison of labour, in order to enhance efficiency and effectiveness in health service delivery. The unrivalled authority of ..... the implication being that if the medical doctor (pathologist) now wants to practice as a medical laboratory scientist, he must satisfy the requirements of the law and be certified by the professional body created.

According to the document obtained by a medicalworldnigeria.com correspondent, the courts also declared

a) Medical laboratory science counci of Nigeria is the statutory regulator for the practice of medical laboratory science / Medical laboratory services in Nigeria

b) Only professionals regulated and or subject to the council in Nigeria and who are qualified medical laboratory scientists that are entitled to practices as professional medical laboratory scientists within the meaning and intendment of the medical laboratory science council of nigeria Act No.11 of 2003

c) An order of injunction restraining the 1st plaintiff, 1st to 5th defendants and or other members /privies who are not subject to and or under the statutory regulation of the 6th defendant from representing, holding themselves out or continuing to represent and or hold themselves out as authorized to occupy any position and or assume any such position reserved for qualified medical laboratory scientist or otherwise interfering in the perfomance and discharge of the functions/duties of a medical laboratory scientists.

This judgement has put to rest any controversy between the MLSCN Act and the MDP Act and thus empowers the council to continue in its fight against quackery in the nation.

ONLY MEDICAL LABORATORIES CONDUCT MALARIA
TESTS, NOT CHEMISTS OR PHARMACIES – NIGERIANS
TOLD

Members of the public are advised to patronize only the
services of the medical laboratory for their malaria tests
among others, as only medical laboratory scientists are
certified, licensed and recognised by Law to conduct such
tests.
This is coming against the jingles on radio supposedly
sponsored by the Society for Family health in conjunction
with the Roll Back Malaria Program asking Nigerians.... https://diagnoscope./2016/02/15/only-medical-laboratories-conduct-malaria-tests-not-chemists-or-pharmacies-nigerians-told/

@Nelszx, thanks for your post on the National Industrial Court judgement.
The freedom and autonomy of the Medical Laboratory Science profession is long overdue.
Now that the court of law has made clear cut pronouncement on hitherto controversial issues, the stage is now set for true professionalism in Medical Laboratory Science in Nigeria and Africa as a whole.

and you're happy?! undecided angry

its unfortunate that we (bsc holders in microbiology & biochemistry) can't sue you guys to court. it would be interesting to see the the kind if judgement the courts will give in a case between AMLSN/MLSCN vs NSM/NSBMB. The idea that a microbiologist/biochemist (bsc) can't work in a medical laboratory is appalling. there's nowhere in the world concessions are not made for bsc holders to follow the biomedical career path. its only in Nigeria that you guys come up with convoluted arguments to justify an absurd idea. smh! too bad

What he's saying is this Medical Laboratory Science(BMLS) is a different course entirely on its own and it's quite different from Bsc MCB and more professional. Instead of laying ur frustrations here get a professional degree that is permitted by law to train Medical Laboratory Scientist through the university. When it was done as post graduate no1 stopped anybody but the diploma has been superceded by a professional degree wc soon will be superceded by a doctoral degree(soon). U weren't trained in a clinical oriented way u can't assume cos u are a Bsc MCB u r free to work in the Medical Laboratory freely. In case u don't know we have Medical Laboratory Scientist Medical Microbiology major and some Dr's in Medical Microbiology so why are you disturbing urslf. You are free to sue it won't hurt. Do you see MLSCIENTIST dragging ur environmental work with you? Know what you are trained to do.

Finish with school first
There's no such thing as Msc in Medical Laboratory Science as a course. It's a specialisation course in the department of Medical Lab science.
Nothing will happen if you don't do ur Msc immediately. Since no such thing as Msc MLS as a course with ur Bsc MCB and whatever Msc u wish to do u work in so many aspects of Microbiology and if you are lucky u might just land an academic position. But working in a hospital clear that off ur mind.

Before taking the Ascp(international) exam for Internationally trained Medical Laboratory Scientists, you'll need to evaluate your credential through World education service and then send a copy to Ascp in the United States. As long as you are well grounded in all the sub-fields like Haematology,Cyto/Histopath, Med.Micro, Clinical Chem, BGS, you are good to go. A colleague has started the procedure already and is taking mock tests on their website.

There is an acute shortage over there and average pay of BioMedical Scientists/MLS in states like California is about $80,000(about 13.5 million naira)/yr. Do the maths.

Thank you sir. I've come a long way since I first inquired about the ASCP. Actually preparing to sit for the exam come July. Please, can I have the phone number or email address of your colleague that was preparing for the exam then? kanayo_ikeh@yahoo.com

Is it not sheer hypocrisy that the same Nigerian Med Lab Scientists who are misinforming gullible Nigerians that Pathologists have no place in Pathology Laboratories are the same people emptying the bank accounts in orders to write foreign exams in order to be certified by American Society of Clinical PATHOLOGIST (ASCP)?

I presume u are in either of the two fields pls utilise ur wider field judiciously. For ur information we're inducted into the Medical Laboratory Science Council of Nigeria (MLSCN) and thereby licensed to carry out duties statutory as a Medical Laboratory Scientist. Channel ur grievances to the appropriate body cos no help here.

Did I tell you Medical Laboratory Science is multi disciplinary too. We have Medical Laboratory Scientist who are specialists in the area of Medical Microbiology/ Mycology / Parasitology (MCB), Chemical pathology or Clinical Chemistry / Toxicology (Biochemistry) as do others in Haematology/Blood transfusion science, Immunology / Molecular Biology, Exfoliative cytology/ histopathology, forensic science etc etc. We're not just in the laboratory testing samples we're saving souls.

Need I tell you, no Medical Laboratory Scientist can and will ever run errands for any doc if you understand my point.

If you are so interested go through DE if it's available and do it else explore ur field very wide. Do have urslf a great day

Have you checked what ASCP is about? A marriage between pathologist and Medical laboratory scientist. When is it a crime to be recognised by a body who acknowledges ur existence? Same way Medical Laboratory Scientist are acknowledged and admitted into the Royal college of pathology UK. A scientist certified by ASCP carries with it the title MLS (ASCP) same goes with the doctor; MD (ASCP). Likewise in the UK he bears the title FRCPATH after his MLS, same as the Doctors

Do you know after such trainings dey become consultants Medical scientists.

Dats what our brothers in Nigeria don't know rather dey want to enslave the other. While basically both are pathologist. A Medical Laboratory Scientist is trained in ALL areas of pathology in B.MLS level and he chooses to specialise in one aspect of pathology post graduate.
