Dear All,
My truck carrying a Loaded contai er from Tincan was seized in March 2015 By Customs officials on its way to Abuja in Benin City.
I have been to Benin and Owerri to Benin requested document for its release uptill this moment. Nothing has been done
I have not been Earning income for over a year now and its really affecting my family negatively

I am being punished due to negligence of some officers at thé port and thé container owner in paying the actual fees at thé port

Please anyone who can help me out of this situation should send me a private mail.Thanks any Customs officer in thé house who can help out.

Is it a case of under payment or duty evasion,which?

In the aforementioned cases,your truck ought to be returned to u since smuggling isn't the cause. Who have u met as regards the issue?

Its a case of undervalued duty.The customs want 20million from the Cargo Owner which they cant afford to pay

Since it's a case of under-value,I see no reason why Customs should hold on to your truck when it's not detention or seizure.

I guess this is when u need the services of a lawyer that can take up your case on pro-bono. U may need to look up @the extant laws(CEMA) governing the modus operandi of the NCS as it relates to detention and seizure which I believe lays emphasis on seizing the means/mode of transportation but silent on cases on under-valuation of goods.

A proper value of the goods can be ascertained and D/N issued @the port of entry to the agent/importer.

In all honesty,u were just caught up in a bad situation and your truck ought to be released to u.

20 million is meant to be settlement fees for thé undervalued cargo.

Thank you very much i appreciate your advise ,i forgot to mention my lawyer wrote the Customs a letter since Dec/January 2016 but they are still holding on to the truck and no word from them

Court summons will suffice. Ask your lawyer to go through the operational guidelines which is captured in the CEMA cause I know it's only in cases of detention and or seizure that the mode/means of transportation can be grounded(detained or seized)
