SKYQUEST: Trying to get evidence to indict the police who is also the prosecutor is a first step towards losing this case. If you have spent some time as a lawyer, you will understand how futile fighting the police can be. Moreso, the car owner can even accept to have requested that amount as his cost of recovering the car if the mechanic wanted out of court settlement. |

Police hate Lawyers so much, get a lawyer who knows the State Police Commissioner or AIG of the zone and see them run away from the setup. |

Once the police knows that you have involved a lawyer, you are indirectly telling them to their faces that you want war! As you are contacting your own lawyer too, remember that in court, it's not always the person who's telling the truth who wins, it's about what you can prove. Convincing a judge that your brother who was caught red-handed driving a stolen car isn't a thief, with the argument that the "real thief" brought it to his mechanic workshop suddenly disappeared? E go hard o!!! Me sef no go believe you. Except you will find a way to track the guy who brought the car to his workshop with an underground means. Another option is to set up a spy camera and film them asking you to pay 300k and threaten to blackmail them with it. 2 Likes |

I don't really care if it is a set up or not. By asking for bribe and refusing to do investigation on the clue they have is criminal. But you need a video or audio footage of them asking you money. Because that is so deniable. You also need to get the contact and picture of the person behind the phone from network provider. Was that not why govt wanted everyone registered! The police needed to work on that clue but since they refused, you can go to any near office and get the person behind the number. I am like 90% sure it is a new scheme to dupe unsuspecting member of the public by some scrupulous police officers |

It may be a set up it may be a coincidence because every mechanic suppose to have a Log book,this is a book where details of any vehicle brought to the workshops for repairs were recorded including the details about the owner of the vehicle in some instances if the owner is not well known to the mechanic he is expected to request for identification card....... my brother if the vehicle was not captured in the log book na long story be that. 2 Likes 1 Share |

MadCow1: Its common knowledge that a Mechanic workshop is a public place where pple go to get their cars fixed. So its absorb to state that the Mechanic received a stolen goods when its apparent that proof of ownership is not a criteria used to effect repairs on faulty vehicles. Back to the topic, the Lawyer should seek for the enforcement of his fundamental human right immediately in a FHC based on the fact that his incarceration has exceeded 48hrs Max as required by d Constitution. He should also involve the Human right Commission as well as the Police Commission about the unlawful continuous detention Secondly, the print media should be involved, just as I wouldn't fail to commend your effort in bringing it Online so that the Court of Public opinion would make an input. Please I would advise you to give detailed information about the Persons involved in the matter as well as the exact police station where the Mechanic is being detained. Lastly, the next action the police would take is to charge him to court and add some trumped up charges that would make them look as if the are indeed committed to their job but don't be worried as the case would be thrown out once your lawyer file a No case Submission. |

Pure set up,get a lawyer but the downside is with our justice system AT suspects spend a while in detention before closure of their case files/court hearing.God help your friend. |

my advise to all artisans association.for anything anybody brings to you for repair you should have a form where the fills all his/her details thumb printed and signed with an attached photocopy of his/her valid id.so that you can have something to present in cases like this.and as time goes on you can continually update the form to suite your challenges.lets stop behaving like we still live in the stone age because we don't take data seriously.good luck to him. 3 Likes 3 Shares |

It was a setup,but as it is now in my opinion is to beat the price down and let them carry their wahala dey go,because if you hire a lawyer now before anything 50k or more will be paid and if you go to court,time will be lost and even if you win,am not sure if they'll pay your legal bill over there in Nigeria,and the chances of winning are very minimal. Handling of stolen goods is a crime on his own. It will cost more to go to court in my opinion,if you have a police contact then look for the ig or contact the commissioner of pol,he may be of a great help. It was a set up. Sorry am lazy to write much. |

Ranchhoddas: The Law would not factor in your social status when delivering a judgement. It's your responsibility to carry out due diligence on every transaction before completing it. Extinuating circumstances may save you in some cases but you don't want to take such chances. Other garages are doing it, they know the law that's why they do it. This is why many businesses that are high risk make their clients sign waivers and indemnify them from prosecution. Take this as a lesson and live accordingly. blessedgal:that was our they arrested three of my cousins brothers in there house in Benin sAying that they got info that they where cultist no arm was found on them they paid 200k before they could freed. Some of this policemen are criminals. |

Its just a ploy to extort money from the mechanic and he might possibly go to jail if no one comes to his rescue, a similar event has occur to my mum before and we ended up spending 200 k to the police. |

patrickdarlins: I did not finish the entire write up but it's wise to get a lawyer. Your friend won't even be charged. Ask me why? His statement will definitely set up an alibi for him. He must state where he was at the date and time that the vehicle was stolen. It will be up to the police to confirm whether or not he was where he claimed to be. Two things will happen. If it's confirmed he was where he claimed at the time of robbery, he will be released. If police does not investigate, he will still be released. If they charge him with receiving stolen goods, an ingredient of that crime is knowledge. A good lawyer can lead evidence to show he had no knowledge of the incident leading up to him taking custody of the car. He will need witnesses who will testify that he is of good character. A lawyer will be helpful. He can apply for a writ of habeas corpus so that his fundamental human rights are not infringed by continued detention. The offence itself is bailable. All the best to your friend. |
