Please dear nairalanders.... This is a serious issue that involves the POLICE as I speak/type.. My close pal's BROTHER IS GOING TO JAIL FOR A CAR HE KNOWS NOTHING OF....

he is a mechanic(repairer of cars and all its parts) he is well known by every body in his location and is very good at doing his work and his customers loved him for his sincerity.

On a very good afternoon he was approached by a customer who wants to REPAIR HIS CAR..after all negotiation and bargaining.... He agreed to the price and gave the CAR KEYS to the man(the mechanic)... To test drive the car after everything.... And so he left the mechanic shop.

It wasn't up to 25mins, he was approached by POLICE and another owner of the same car that was dropped at his shop 25mins ago.... And the police men arrested the mechanic Guy saying he is a criminal that he stole the car from the owner in BENIN CITY, that the owner of the car packed the car inside his compound and all of a sudden the car was no where to be found. That they have been looking for the car for almost TWO WEEKS now that they got information from sombody that's how they got to know that the car is packed in his (mechanic guys) shop..

The mechanic guy is in police custody as we speak... And he kept calling the guy that brought the car to his shop and guy kept telling him he is not in town that he will be back in some hours hours time... It has been like that for almost 5days now... The man refuses showing up for his self acclaimed car.

Now they are planning on transferring the case from warri to BENIN tomorrow or next.... But they gave the mechanic guy some conditions if he want the case to be sealed..

The police men and the owner of the stolen car has told the mechanic guy to pay up #300,000 for the case to die down and for the replacement of some properties that are not inside the car at this moment.

Now... We beginingto suspect that this whole thing is a planned work and a SETUP Plan against the mechanic guy... Cos if you look at it very well you would notice that a stolen car from Benin to warri can not be tracked down immediately after the person who stole the car dropped it inside a mechanic shop and all of a sudden the owner of the so called car shows up from no where all the way from Benin? With the police?? How is that possible? I don't understand... It must be a set up...

DDEAR NAIRALANDERS... We planning on hiring a a lawyer and maybe take this issue to the court tomorrow... PLEASE WHAT IS YOUR BEST ADVICE FOR US AT THIS MOMENT? SHOULD WE OR SHOULD WE NOT INVOVETHE LAWYER? what other steps do you think we can take against this case?...

Please mature responses.... Thanks in advance....

.... Please I need urgent replies now.... Abeg ooo

The moderator of this thread should be investigated. I posted on how the OP can contact the police on these numbers ‪+234 805 700 0003‬,‪0 805 700 0002‬,‪0 805 700 0001‬. The post just suddenly disappeared

They obviously want it to get out there.. To d IG if possible

Or why did you post police numbers, are they lawyers?
What should he call them for?

SKYQUEST:
The most important thing is for the OP to put the demand of N300, 000 on record for evidence purpose. Once that is done, it becomes easier to pursue the case in court. It may take time and some pain but the police will be nailed. I believe being convicted for receiving stolen goods involves knowledge that the goods being received is stolen. The mechanic is in the ordinary course of his business. You need a good lawyer though.

Trying to get evidence to indict the police who is also the prosecutor is a first step towards losing this case.

If you have spent some time as a lawyer, you will understand how futile fighting the police can be.

Moreso, the car owner can even accept to have requested that amount as his cost of recovering the car if the mechanic wanted out of court settlement.

Police hate Lawyers so much, get a lawyer who knows the State Police Commissioner or AIG of the zone and see them run away from the setup.

So mechanics should start requesting for proof of ownership before working on a car.Your username is fitting.

The fact that this sounds impractical to you shows the minimal range of your reasoning ability.

Incase you don't know, Established garages already do this as a matter of standard practice in Nigeria.

Once the police knows that you have involved a lawyer, you are indirectly telling them to their faces that you want war! As you are contacting your own lawyer too, remember that in court, it's not always the person who's telling the truth who wins, it's about what you can prove.

Convincing a judge that your brother who was caught red-handed driving a stolen car isn't a thief, with the argument that the "real thief" brought it to his mechanic workshop suddenly disappeared? shocked E go hard o!!! Me sef no go believe you.

Except you will find a way to track the guy who brought the car to his workshop with an underground means. Another option is to set up a spy camera and film them asking you to pay 300k and threaten to blackmail them with it.

I don't really care if it is a set up or not. By asking for bribe and refusing to do investigation on the clue they have is criminal.

But you need a video or audio footage of them asking you money. Because that is so deniable. You also need to get the contact and picture of the person behind the phone from network provider. Was that not why govt wanted everyone registered!

The police needed to work on that clue but since they refused, you can go to any near office and get the person behind the number.

I am like 90% sure it is a new scheme to dupe unsuspecting member of the public by some scrupulous police officers

I think you need to add number 11, he should sue them for damages they have cost him. Good outline u did though stay blessed

BiggerBangs:
Haha.. Why the fuse? Tell the man (mechanic)to relax ,this is a planned setup probably by one of his rich client he might have early offended.

Solution :

1: Be ready to spend money to finish the case

2: Get a good Lawyer

3: cooperate to pay the 300k Bribe ( but don't )

4: Get a documented evidence that they requested for a settlement of 300k

5: Write a letter to the state commissioner of police to transfer the mechanic to police headquarters for safety because they may attempt to kill the guy in his cell

6:Then head to Court

7: Add the most important ingredient by praying because the case has been planned and finished before the guy got arrested

8: Wait till Court discharge and Aquit the Mechanic

9: Don't forget to publish the names of the police officerS that mastermind the crime here on Nairaland because they will be dismissed

10: Thank me later

hmm. this is a tough one, but from my own view of things, this is a set up. I will advice him to get a good lawyer and take the case to court instead of paying the 300k that was demanded. he has a high probability of winning the case. I wish him luck. blessed be.
. It may be a set up it may be a coincidence because every mechanic suppose to have a Log book, this is a book where details of any vehicle brought to the workshops for repairs were recorded including the details about the owner of the vehicle in some instances if the owner is not well known to the mechanic he is expected to request for identification card....... my brother if the vehicle was not captured in the log book na long story be that.

Receiving Stolen Goods is a Criminal Offense under the Laws of the Federal Republic of Nigeria..

#Ignorance is not an excuse under the Law.

It is your responsibility to carry out due diligence on the property before receiving or purchasing it.

Its common knowledge that a Mechanic workshop is a public place where pple go to get their cars fixed. So its absorb to state that the Mechanic received a stolen goods when its apparent that proof of ownership is not a criteria used to effect repairs on faulty vehicles.
Back to the topic, the Lawyer should seek for the enforcement of his fundamental human right immediately in a FHC based on the fact that his incarceration has exceeded 48hrs Max as required by d Constitution. He should also involve the Human right Commission as well as the Police Commission about the unlawful continuous detention

Secondly, the print media should be involved, just as I wouldn't fail to commend your effort in bringing it Online so that the Court of Public opinion would make an input. Please I would advise you to give detailed information about the Persons involved in the matter as well as the exact police station where the Mechanic is being detained.

Lastly, the next action the police would take is to charge him to court and add some trumped up charges that would make them look as if the are indeed committed to their job but don't be worried as the case would be thrown out once your lawyer file a No case Submission.

Very Sound.

He definitely needs to get a lawyer as his continued detention is illegal.

my advise to all artisans association.for anything anybody brings to you for repair you should have a form where the fills all his/her details thumb printed and signed with an attached photocopy of his/her valid id.so that you can have something to present in cases like this.and as time goes on you can continually update the form to suite your challenges.lets stop behaving like we still live in the stone age because we don't take data seriously.good luck to him.

It was a setup, but as it is now in my opinion is to beat the price down and let them carry their wahala dey go,because if you hire a lawyer now before anything 50k or more will be paid and if you go to court, time will be lost and even if you win,am not sure if they'll pay your legal bill over there in Nigeria, and the chances of winning are very minimal.

Handling of stolen goods is a crime on his own.

It will cost more to go to court in my opinion,if you have a police contact then look for the ig or contact the commissioner of pol,he may be of a great help.

It was a set up.

Sorry am lazy to write much.

The Law would not factor in your social status when delivering a judgement.

It's your responsibility to carry out due diligence on every transaction before completing it.

Extinuating circumstances may save you in some cases but you don't want to take such chances.

Other garages are doing it, they know the law that's why they do it.

This is why many businesses that are high risk make their clients sign waivers and indemnify them from prosecution.

Take this as a lesson and live accordingly.

Trading words online will not change the law in yours or the Mechanics favor.

How does a mechanic know if a car is stolen?
I take my car for repair and nobody has ever asked me for proof of ownership.

Its just a ploy to extort money from the mechanic and he might possibly go to jail if no one comes to his rescue, a similar event has occur to my mum before and we ended up spending 200 k to the police.

I did not finish the entire write up but it's wise to get a lawyer. Your friend won't even be charged. Ask me why? His statement will definitely set up an alibi for him. He must state where he was at the date and time that the vehicle was stolen. It will be up to the police to confirm whether or not he was where he claimed to be. Two things will happen. If it's confirmed he was where he claimed at the time of robbery, he will be released. If police does not investigate, he will still be released. If they charge him with receiving stolen goods, an ingredient of that crime is knowledge. A good lawyer can lead evidence to show he had no knowledge of the incident leading up to him taking custody of the car. He will need witnesses who will testify that he is of good character. A lawyer will be helpful. He can apply for a writ of habeas corpus so that his fundamental human rights are not infringed by continued detention. The offence itself is bailable. All the best to your friend.
