A car that was brought to a mechanic to fix. was it written that he bought d car??

You so dont get it..

Uncle; "HE SAID".... The care was brought to him for Servicing.

The Police does not know that he is telling the truth.

Nothing says he is not working with the Robbers who stole the whip.

Nothing says he was not trying to fence the car on their behalf.

Nothing even says he didnt steal the Car himself and drove it to his garage.

If the Police were to believe the stories every suspect tells them, our Jails would be 95% emptier than they currently are.

Get it?!

Thats why is he had something in writing from the Perp saying he only received the vehicle for repairs and had vehicle documents he had cross-checked to back him up, he would be in a much better position than he currently is.

Until it is proven otherwise, his Charge remains 'Posession of Stolen property'.. Proving Miens Rea is all that is left for the Prosecution to shut the Prison Cell behind him. grin

Receiving Stolen Goods is a Criminal Offense under the Laws of the Federal Republic of Nigeria.

#Ignorance is not an excuse under the Law.

It is your responsibility to carry out due diligence on the property before receiving or purchasing it.

I agree - ignorance is no defence. However, how can one carry out due diligence on a car brought to a mechanic? How?

............................

Simple..

When a New client comes in, You pull out a form where the Client writes his name and mobile phone number. You can cross-check the Vehicle particulars against a Government issued Identification like International Passport, Drivers License, Voters Card, National Identity card, e.t.c.

If its a Company vehicle, you ask him for a reference letter from the Company with the vehicle.

It's called Procedure. Ask Stallion, Briscoe, Elizade, Coscharis, Germaine, Mandilas, CFAO, e.t.c how they do it..

Please dear nairalanders.... This is a serious issue that involves the POLICE as I speak/type.. My close pal's BROTHER IS GOING TO JAIL FOR A CAR HE KNOWS NOTHING OF....

he is a mechanic(repairer of cars and all its parts) he is well known by every body in his location and is very good at doing his work and his customers loved him for his sincerity.

On a very good afternoon he was approached by a customer who wants to REPAIR HIS CAR..after all negotiation and bargaining.... He agreed to the price and gave the CAR KEYS to the man(the mechanic)... To test drive the car after everything.... And so he left the mechanic shop.

It wasn't up to 25mins, he was approached by POLICE and another owner of the same car that was dropped at his shop 25mins ago.... And the police men arrested the mechanic Guy saying he is a criminal that he stole the car from the owner in BENIN CITY, that the owner of the car packed the car inside his compound and all of a sudden the car was no where to be found. That they have been looking for the car for almost TWO WEEKS now that they got information from sombody that's how they got to know that the car is packed in his (mechanic guys) shop..

The mechanic guy is in police custody as we speak... And he kept calling the guy that brought the car to his shop and guy kept telling him he is not in town that he will be back in some hours hours time... It has been like that for almost 5days now... The man refuses showing up for his self acclaimed car.

Now they are planning on transferring the case from warri to BENIN tomorrow or next.... But they gave the mechanic guy some conditions if he want the case to be sealed..

The police men and the owner of the stolen car has told the mechanic guy to pay up #300,000 for the case to die down and for the replacement of some properties that are not inside the car at this moment.

Now... We beginingto suspect that this whole thing is a planned work and a SETUP Plan against the mechanic guy... Cos if you look at it very well you would notice that a stolen car from Benin to warri can not be tracked down immediately after the person who stole the car dropped it inside a mechanic shop and all of a sudden the owner of the so called car shows up from no where all the way from Benin? With the police?? How is that possible? I don't understand... It must be a set up...

DDEAR NAIRALANDERS... We planning on hiring a a lawyer and maybe take this issue to the court tomorrow... PLEASE WHAT IS YOUR BEST ADVICE FOR US AT THIS MOMENT? SHOULD WE OR SHOULD WE NOT INVOVETHE LAWYER? what other steps do you think we can take against this case?...

Please mature responses.... Thanks in advance....

.... Please I need urgent replies now.... Abeg ooo

Lol... grin

Uncle, caution is never a bad thing. I work in the Oil and Gas Industry and Safety and Caution is the mantra. grin

Assuming the mechanic is telling the truth, what he did with this vehicle must be standard practice for him. Now look where that shiit is about to land him. grin

Feel free to disregard my advise. Atleast you can't feign ignorance when you get caught out.

We all think shiit can't happen to us until it happens.

Washing car is different. The Owner or Driver is right there with you. But if they are leaving the Car in your possession overnight or to go somewhere and return later, you would be very stupiid not to get some Identification from the driver. VERY VERY STUPID.

Caution is never and will never be a bad thing, Just annoying. grin

Guy this is the fastest solution. Do you know any army officer anywhere in Nigeria or around benin warri axis.or You can Go to the nearest army barracks report to an army officer or the nearest JTF post. Report this to them. Give them like 20K for fuel and refreshment. They will march down to the dat police station immediately and the guy will be released today today. All they need to do is to claim the guy is his younger brother.

its not sentiments. Its facts of de case and technicality that 'll make him win. He didnt receive de car to buy but he collected to repair. That absolves him of de issue of carrying out due dilligence before purchase. The issue is simple setup.if not just collect de man's number and trace him. The police, were they not hearing de man sayin that he'll come?yet they dnt want to trace him.

And you know he did not receive the car to sell it how? Because the OP said so? Or because he said so? Do you think that in itself will suffice as a defense in Court?

Like seriously?

Bro, it will take more than his testimony to get him off.. He was caught RED HANDED with the Car. The alleged Owner who can corroborate his story is at large. No name, just a phone number. If that person denies giving him the vehicle, then it becomes the Mechanics words against his own. grin

You see why it was necessary to do due diligence on the Owner?

Lol..

Aunty, All he is saying is that when somebody who isn't a customer comes into your business and is willing to leave his property with you for you to work on, its only right that you get some details off of the person.

As Laymen, we don't practice these things, but look at the implications of it..

Exactly, getting details from customers is not something roadside mechanics do. Sure, you can advice that in order to avoid stories that touch all mechanics should adopt this method but y'all are sounding like all the other roadside mechanics do these things and this particular guy did not. He did nothing out of the ordinary.

Pray tell, how does a mechanic carry out due diligence for a vehicle that was brought to his workshop for REPAIR. Not for sale, REPAIRS.

Solution: Get a Good Lawyer..

The first thing is to determine that this is not a scam.

If this is real, he needs a Good Lawyer whose first job would be to dismiss any Testimony or Statement he may have written from the records as being given under duress without proper legal representation.

Then based on the facts on ground, his lawyer to determine the best defense to use for him.

Simply put; GET A GOOD LAWYER.
