The ISSUE here is does the EFCC have the power in law to freeze the bank account of a citizen or not without recourse to a Court of law?. The answer in view of Section 34(1) of EFCC Act, is an emphatic"no". If EFCC cannot freeze any citizen's account without recourse to a court of law and section 308 of the Constitution says you cannot take Fayose to court because he is a Governor, does it not simply mean you cannot freeze Fayose's account as a Governor?
