The Federal Government today lost its bid at the Federal High Court Abuja to conduct secret trial of former National Security Adviser, Colonel Muhammad Sambo Dasuki (Rtd) in the charges of unlawful possession of firearm and money laundering brought against him in September 2015.
The court said that there was no point for the witnesses billed to be called to testify in the matter to wear masks and bear pseudo names.

Delivering ruling in an application for secret trial of former NSA, Justice Adeniyi Ademola held that the federal government had in its charges listed the names and addresses of 11 witnesses to be called to testify against Dasuki and made same available to the general public and as such there was no basis for any hide and seek game in the trial.

Justice Ademola in the ruling that lasted over one hour, rejected the plea by government that the court during Dasuki’s trial be closed against the general public except the lawyers involved in the trial and accredited Journalists.

Justice Ademola said that there was no basis to grant the request of government to make the witnesses wear special mask, bear pseudo names and addresses because the charges against Dasuki was not terrorism related and that there was no information that the life of any of the witnesses billed to be called was being threatened by anybody of group.

The Court held that although, it has a discretion to look into such issues of protection of witnesses in a criminal matter but that such discretions must be judicially and judiciously used only in cases where threat to life has been established by the prosecution.

In the instance case, Justice Ademola said that government failed to establish any fact that life of its witnesses was being threatened and as such no court of law would accede to such requests without established reason.

This is how they twisted Tsosho's hands and against his better judgement get reversed his own decision not to use masquerades as witnesses in Nnamdi Kanu's case. If u read the entire op, you'd have seen that the FG had already provided names, addresses and other necessary details of the witnesses it intends to call. Those are already filed in the court as public documents so why d deceitful attempt to probably smuggle fakes and impostors into the system?

If they had real regards and there was any real threat against the witnesses, they wouldn't have placed their details in the public domain. They would have actually taken steps to ensure d safety of d witnesses. Even at that, there is no report of a threat against any of them so what exactly is the FG trying to hide? This is not a terrorism case bit one of embezzlement and misappropriation/diversion of public funds so why d drama?

I think he was the one that discharged Kanu of the fake terrorism charge against him and released him unconditionally or the one Kanu claimed that he get fair trial before (either of the 2) but he has handled Kanu's case in the past.

It is not unusual for witnesses to be masked or hidden from public view when the defendant is someone as powerful as Dasuki and they fear retribution . It is sometimes done here even during Congressional Testimonies of Government informants/witnesses. What the Prosecutor need to instill in the heads of the witnesses is that if they for whatever reason get on the stand, under oath, and give alternate/false testimony than what they have previously provided the Government they will be charged with perjury and obstruction of Justice. The first person to get on the stand and chicken out should be made a good example of and hit with the stiffest sentence available under the law for perjury.

In the interim, the Government should promise - and fulfill it's promise- to protect its witnesses with adequate security for upwards of a year or two and also relocate them anywhere in the country they wish to go,complete with new identities if they so wish (or deem it necessary). They should also be compensated financially. Anything other than full assurance of protection from the Government and they run the risk of blowing their own case if the witnesses get on the stand and choke when they remember how powerful and dangerous Colonel Dasuki is; capable of eliminating them from the face of the earth if he so wishes if he ever becomes a free man.

Below is a link and video to one of such testimonies where an informant and former member of the KKK for the U.S Government testified before Congress. His identity was known before hand and we all knew his name, but he was allowed to wear the mask to conceal his identity for those (majority of the rest of the world) who didn't previously know what he looked like . And after his testimony he was taken into the Federal Witness protection program, relocated, and given a new identity. Without actions like these, bad men would've still been roaming free.
