There was a country.. 1.4bn of illigally gotten money meant to purchase arms to protect lives and property from the bokoharam virus hides in a persons bank account but we are more concerned about the persons immunity?

Is like law is no longer the noble profession we used to know. Come to corporate affairs commission Abuja and you will see many of them hanging outside the building like motor park tauts , the rush at anybody approaching d building so as to be hired to do one thing or the other .

Constitutional Lawyer and former National Secretary of Labour Party, Mr. Kayode Ajulo, on Tuesday, described as “illegal” the freezing of Governor Ayodele Fayose’s account by the Economic and Financial Crimes Commission, EFCC. Ibrahim Magu According to Ajulo, EFCC’s action was an abuse of the immunity that covers governors in Nigeria. Ajulo in a statement said he received the news with shock, arguing that, EFCC has no legal ground to freeze Fayose’s account.

[b]The statement read: “This indeed came as a shock considering the personality involved, a sitting governor that enjoys immunity till the determination of his office as governor of a State in Nigeria. “It is the law that to freeze an account, there must be an order of court for the attachment of the bank account. It is also trite that for the court to make such order, there must be papers (court process) filed in court and signed by the judge.” He further said: “By the provision of Section 308(1)(a) of our Constitution as amended no suit can be instituted against Ayodele Fayose and/or any Nigerian governor in any court in Nigeria. “Therefore, no process of court can be issued, signed or served, against Ayodele Fayose in his personal capacity, whereas the bank account in question is his personal account as such in his personal name. “Moreover, sections 26-34 of the EFCC Act, established a process to be followed that is, a suspect must have been arrested for his account to be frozen however section 308 of 1999 Constitution, exempted Ayodele Fayose from those could be arrested and his bank account cannot be frozen. [/b]
It behoves on all right thinking Nigerians and law abiding individuals and corporate entities to ensure and insist that EFCC acts according to the law of the land and adheres to best international standard and practice. The constitutional lawyer warned, “It should be warned that EFCC is gradually turning into an unchecked tyrannical monster. If indeed Ayodele Fayose has a case to answer, the case of Bola Ahmed Tinubu Vs. Gani Fawehinmi is apt and locus classicus; Therefore, EFCC should lift the attachment on Ayodele Fayose’s property, go ahead to investigate him but wait for Fayose to complete his term of office before commencing his prosecution. That’s the law and it must be followed.”

I love to hear people who claim to be smart make fo0ls out of themselves.
The writer forgot "plausible cause" . Plausible cause negates all the immunity Fayose thinks he has under the Constitution.

Immunity is not absolute. For example: If there is an evidence that Fayose is stockpiling arms to overthrow the government, the immunity clause does not protect him from arrest and prosecution because he is a governor. There is a big difference between mistakes made in discharge of duties vs. criminal act.
Law is not arithmetic where one can say 2 x 2 = 4.

Having gone through all the comments above, it is a wonder many are in support of corruption because there is a law giving immunity to a thief. Have you considered the Psychological effects on most Nigerians interested in this case if a corrupt official walks free because of an immunity clause? This country needs deliverance from the nature of corruption. God help us.

Hmm, I read some comments here where some posters are bemoaning the President FRN. Its a pity that yet the bunch of Nigerians themselves lacks direction and reasoning. They have failed to see positives in clumsy situations and this is because they do not think themselves and neither do they have anything to offer but to take. We are in a country that is richly blessed with both human, and natual resources beyond the likes of the top world powers and yet we are rated to be very poor in the midst of plenty.

Either tyranny or not tyranny, I do not give a damn as what I give a hoot about is how come he has such large amount, is he a business man, if yes, what kind of business did he do to have so much? This question should be what we should also be asking and not shouting I regret, some people are left alone,bla bla bla, what is my business. See every thief has its own dawn, and they will all have it, if not in their life time, they will when they face God. If the so called tyranny of PMB is what will lead to the dawn of Fayose here on earth, let it be. In disorganisation we shall find our organisation.

Infact, every rich individual in Nigeria should be probed, it might come tyrannically, systematically, dogmatically, foolishly, slowpokingly or cluelessly as long as they all meet their dawn even if time varies.
