This is not the way to treat the dead. The hospital needs not sensationalize it afterall LUTH has been burying unclaimed dead bodies for years without this kind of public ridicule. Just advertise and get the affidavit to support the claims that the relatives didn't come forward to claim the bodies and on the day of burial, all agencies of government be represented to witness it.
If every court starts taking this kind of plea, there will be no time for more serious things. I think that CMD, Mr Allagoa should be cautioned by the Medical and Dental Council of Nigeria. It's purely unprofessional,a dead body without claim has no locus standi so who is he fooling?

it's not right to bury corpes without consent from d owners. They may come up 2moro with a legal suit against the hospital (some pple can do anything for money grin)

The hospital is being cautious. I won't blame them. If they are buried without court permission/order, someone might appear one day and begin to claim ownership of any of the corpse. In that case, the hospital will be liable to pay.

They can't without the consent of the relatives and it appear that, the laws are silent on what happens, if no one comes up to claim the bodies, hence the court order, in case someone from somewhere comes up tomorrow and sue them for burying their relative without their consent.

Yes, in the ensuing court case, the government will win, if they argue abandonment, but they would have to spend money to defend themselves each time those cases comes up(some hospital will even settle to avoid going to court)...but with this order, even if anyone file any case, it will be tossed after administrative hearing during pre-trials.

I think the laws should be amended to give the hospital automatic full custody of corpses, if they are not claimed with certain prescribed period of time and cases like these will not be needed.

Did you not read the part of the article that said the corpses have been abandoned for years? Anyone that comes forward claiming an abandoned corpse for that long deserves to be arrested and fined.

Nice submission. It is not always a case of abandonment. There might be a scenario where two or more people are laying claims to a corpse, the hospital might be confused and just decide the keep the corpse. This is clearly not a case of abandonment but dispute as to the ownership of a corpse.
