It is illegal for me to jump into conclusion here cos I perceive this your story aint complete.

I doubt if your tenants would adamantly demand a free 3 months rent just like that without any explanation or reason. 4 of them at once? No I don't believe it, there is more to it.

My dear it depends on you,cux last year I collected rent from my tenant before completion of the building and some moved in when there are some minor works I told them that there rent will start when I complet the work which took me like 3xtra months and immediately the work is completed I gave then reciept and they signed aggrement form

my rent expired precisely on september 30 2016 and i already told my landlady of my intention not to renew, now she says she is giving me till the ending of this week to move out even after telling her that she has to give ME a little time cuz have been so busy and i just started searching for another apartment...WHAT DO I DO ?

(1)three months is around the corner, if u must handle them allow them stay for three months and then request ur full money and if they fail to pay then take them to court and let the law handle them. they will pay speedily.
if u can't do this then use any of the two other options

(2) get a property lawyer fast

(3) don't take laws into ur hands

clearly u haven't read the constitution and u haven't been to law court be4. In as much as the landlord owns the house, the tenants have rights too. The tenancy law States that a yearly tenant (rent paid annually) is entitled to 6 months notice to quit.

While a monthly tenant (rent paid monthly) is entitled to 1 week notice to quit.

This provision is valid ONLY when the rent is running and hasn't expired. If the rent is expired and tenant isn't willing or able to pay, you can get redress from the court by having them removed (ejected) from the property and seek redress in terms of unpaid rent from the tenants.

If their rent is expired and you didn't notify them before the provisions of the law, you have to both reach a compromise.

If the rent expired, they aren't willing to pay, and becoming difficult, please go to court and as long as the ruling takes, the tenant will be ordered by the court to pay you. The law protects both tenants and landlord.

When you file in court, ask your lawyer to include all outstanding rents (past and furure) until you get possession of your property.

Your next set of tenants should have a proper agreement drawn and signed.

A landlord cannot just ask a tenant to quit a property without notice.

A tenant cannot deny a landlord income on the guise of moving out.

Speak to a lawyer.

Ur case is stil better...av got a stubborn tenant who refused to pay.after givin her 6months free to vacate.still went ahead to report to human right.lawyer served her 7dayz quick notice..d. Up. Til nw she's stil der.

It's not possible to live in my house for free. weather 3 months is close or not the must pay me my money. i build that house with my hard earn money . there's no law that will favour somebody not to pay his house rent. there rent have expired so the should be ready for me. since there's no law in Nigeria again. I will take law into my hand now. i will use them as example next time the will not play with anybody the see. the have pushed me to the wall

I learnt this from a colleague of mine,when a new tenant enters his house the tenancy agreement is accompanied by a quit notice which is signed by the tenant.

The minute you fail to pay he is within the confines of the law to evict you immediately.

Don't joke with Port harcourt landlords oh.

You better dont do that, my neighbour has been staying in a his for free for the last four years, the lanlord attempted to evict him forcefully, he went to police station to report, filled for damages saying his house was vandalized jn the process of forceful eviction, properties worth millions and hard currencies were stolen. He went to court, he won, in fact the landlord has been the one paying him rent to last for five years.

There is no law dat says they will live in ur house for free for 3 months. The law only said u shud not throw them out becos they cnt pay rents until 3 months expire. U can still sue dem for d rent. Or if they choose to remain in d house after 3 months they will still pay for d 3 months they stayed without rent.

I have been living in my rented three bedroom apartment free of charge without my landlord coming to me to ask for house rent or anything,thanks to Baba ijebu jazz from home. I won't pay a kobo and I will pack out at my own time. Na who know way get way for Naija

try and dialogue with them ist, this same thing that happened to me.
I was ranting when the matter enter court na it lasted for another two years and I didn't still get my money.
call them talk if the will leave after the three months better, cos even the three months wont be enough for the case to be mentioned in the court. the only advantage you have is that there are owning you which before the case start the court will ask them to pay you then the case whether they will leave or not will start. even the court gives you judgment you will not automatically take possession of the house. you will pay the court to give sheriff and police to go levy execution. you may not see property worth you house rent or they will even run before then.

am saying all this from experience make you no meet perpetual wicked tenant like menix who not planning to be useful to there life other than take landlord sweat not knowing there is cause that comes with it..

That is the law. But, there's a way out. Tell them you want to renovate the house and call in carpenter in 1 week time to start removing their roof. That's how we roll in Ikwerre land.

This is a very stupid and dangerous advice. No one has asked the most important question here. What kind of tenants are they?. What do they do for a living?. Before the Landlord takes any 'illegal' action, he must first access the kind of tenants he's dealing with. Some tenants are capable of killing you on top of your house. In Op's case, for all 4 to gang up and demand the same, means that they are ready for you. Any attempt to use violence or Agberos will backfire.

If you ever remove the roof under any guise, you may lose that house entirely. They may use that 3 months rent to re-roof the house. That is what I will do if I am in their situation. The amount of compensation you will pay to get them out of your house after they have put the roof back will build you a new house.
So thread very carefully and most importantly KNOW YOUR TENANTS. Armed robbers are tenants too.

Lies. Landlords and Tenants Laws applicable in Nigeria did not say so. Serve them notice to quit and 7 days owners intention to recover possession, ie, at the expiration of the notice to quit.

You really need a lawyer. You can contact me for Legal advice

Well said. Op, listen very carefully and do not try to use any form of force to evict them. Since they said that you should give them 3 months, draft an agreement and let them sign. With that, you can now have a legal backing. Do not use force by breaking into their rooms, if you do, you are in a very big mess.

I own properties and know the implication of any negative action in throwing your tenant out.

Someone here was advising you to throw them out. Never follow his advise.

Op listen to this man. I have seen tenants live in a house for 3 yrs plus free without rent do you know why? Landlord served quit notice and started renovating the house in a bid to force them to park. Tenants went to court and landlord was asked to stop renovating while tenants are still living their. Till today the case is still in court and those tenants are living their for free.

No tenant should live in a house free even if its for one day. Its illegal under any circumstance. Even if u are given notice to quit, the tenants MUST pay their rent for all the time they occupy the property. Owing rent is not the only ground under which a quit notice may be served. Even those tenants who dont owe rent sometimes get quit notice for other reasons. Pls dont mis-inform the public. It is NOT legal to live in anybody's house for free for any amount of time let alone 3months.Are landlords running a charity?
