lielbree:what a sad day for poor Nigerians. 90% are poverty stricken yet we defend most of these thieves and at the same time we set ablaze a man that stole just 5k. Though I am not a Buhari fanatic, someone need to reset our psyche back to "default ".We have been so enmeshed with illegality for soooo long that we have become "immune" to it. Everything MUST have an ethnic angle but these thieves don't give a damn about you peasants. Sad!!! |

Which section of our constitution puts judges above the law and says they can't be arrested by DSS/police or even army if required? |

Wadeoye:"Separation of powers" is a well-defined constitutional concept - https://en.wikipedia.org/wiki/Separation_of_powers - and the point is to prevent governments from degenerating into tyrannies. And yes, it does mean that one arm of government can't simply decide that it has the responsibility to unilaterally purge another, otherwise a slide into dictatorship would be almost inevitable. |

Buhari is a fast learner. He learnt how to crackdown on judges from Erdoghan of Turkey. Yesterday, it was the legislature, today it is the judiciary. Tomorrow it might just be you or me reading this. Democracy has three arms to checkmate the other. While one has become like a snake trying to swallow the other ones is unacceptable. Nigeria isn't buharis estate where he chooses to do as he pleases. There is separation of powers. He went into the economy trying to usurp the power of the cbn and the economy crashed, now he has gone to the judiciary.... Wait... I just remembered that this same buhari pledged to have sharia law in all parts of the country. Hope it's not what is happening... Dismantle the common law which the British gave us under the guide of fighting corruption then install sharia law on Nigeria..... It's time to think....

An institution cannot police itself as has been shown by the executive, legislative and judiciary arms of government in Nigeria. Democracy seems only good on papers considering the ways it is being implemented in Nigeria. Scandal after scandal, everything is swept under the proverbial carpet. Nigeria needs a mix of democracy and dictatorship. As it is, the legislatures only challenge the executive only when their pockets are at stake. The judiciary is for the highest bidder. The executive wants to corner all the power. And in such a mess, nothing progressive has been achieved all these years. Iraq, Libya, Egypt are classical cases to show that democracy doesn't always work. Saudi Arabia and the rest of the Middle East figured it out a long time ago and they are progressing. No matter the best of intentions, put anything good into the hands of Nigerians in government and watch how it will be turned upside down for the benefits of the kleptocrats. \ |

Would you wish to be a woman, a non-Muslim or even a Shiite under the Saudi monarchy? I'm old enough to remember the dictatorships from Buhari to Abubakar, and no matter how rotten Nigeria's current democracy may seem, it is still far better than the military regimes at their worst. At least under a democratic regime one has the freedom to not just complain but even insult bad leaders like GEJ and the "new" Buhari; under the "old" Buhari Decree No. 4 would have seen most of us criticizing him on here summarily detained without charge. Nigerian democracy is massively flawed due to the ill-educated and tribalistic nature of the Nigerian populace, but the dictatorial alternative has all of the exact same problems without even the benefit of freedom of dissent. |

LastProphet:I don't blame anyone saying bad about the president. His inactions wen it concerns family,relations or apc chieftains corruption charges gives room for doubt about his sincerity. I just hope(very slim though),that a sincere corruption fight is about to begin in the judiciary,devoid of sentiments,tribe,party or religion. I knew my uncle justice nkanu wasn't involved.he's the most incorruptible judge around followed by appellate judge joseph oyewole.I don't know much about ngwuta except that he's from ebonyi.inyang okoro is from akwa ibom and is a mole and a lackey of senator akpabio and helped secure the fraudulent rulings on rivers and akwa ibom guber cases.he deserves the treatment.next should be mary odili their leader in chief.up apc,up buhari. |

Wadeoye:Of course judges can be investigated and arrested, just not by the DSS on Buhari's orders. If you bother to look at said constitution, you'll see that the appropriate body for investigating and punishing judges is the National Judicial Council (NJC), a body which is entirely independent of the executive (i.e. Buhari and the DSS). Allowing the executive to arrest judges completely undermines any notion of judicial independence, which means a president can simply railroad his enemies by accusing them of "corruption", safe in the knowledge that the judges will be too scared to disagree with his accusations. This is how dictatorships are born. |

To compare Obasanjo or any of his successors with IBB and Abacha is to do the democrats a huge disservice: I lived through Decree 4 (when Buhari jailed Ekwueme, Awolowo and many others on zero evidence), the murder of Dele Giwa and the execution of Ken Saro-Wiwa, and nothing since 1999 has compared with the terror of those days. Nigeria democracy today is far from perfect - in particular, I agree that the brutal suppression of MASSOB and IPOB is a disgrace to freedom of speech and association - but if you think modern technology is what allows for loud criticism of leaders, take a look at Xi Jinping's China, Putin's Russia, or Turkey since Erdogan began his recent purge. |

I am commenting generally without reference to this matter specifically , But investigations and prosecution is not the remit of the NJC. The NJC cannot ,CANNOT give jail terms ,it is not a court. If a judge is accuse of rape or kidnapping it is NOT for the NJC to investigate and punish |

sanpipita:I disagree with you... Judiciary doesn't have absolute power and they are not operating in their own world or a separate constitution. They can be arrested and prosecuted even without any NJC investigation. The issue is, they still have to be taken to court for prosecution where they will have the opportunity like any other accused persons to defend themselves. |

The rest are countries like Nigeria, Angola, Venezuela, Zimbabwe, Afghanistan, Burundi, Colombia, Chile, Ecuador.
