You are right but it says investigate not seize or is that not what is stated out there

“Section 28 says concerning those arrested under the Act, the commission will immediately trace and attach all the assets and seizures of such a person which have been acquired.

This partains to section 71b

“Section 29 permits the assets of a person arrested under Section 28 to be seized by the state

It is not my opinion!! The charges preferred against him are in the public domain and stealing is not one of them

Your opinion that the charges border on speculation.

If you remember very well the case against her is dead or Dead on arrival . The burden of proof o's on the prosecution ie EFCC .
Lol you have no idea what you're talking about. Patience cannot do anything but watch the state seize that money. The money was traced to some registered companies not Patience. Those companies have pleaded guilty to money laundering charges through their directors. Patience is not a director. So the money reverts to the state. Her only claim to that money is the Platinum master card in her possession. That is not enough proof of ownership. The account was not even in her name. Money belongs to the state. Case closed.

Oga its like you're privy to information the rest of us are not privy to. How do you know patience has explained the source of the money found in her Supossed account? On the pages of newspapers? Has she reported to the EFCC? Did she write a statement or depose any affidavit? Have you seen the statement or affidavit?

Section 7 of the EFCC Act says: “The commission has power to (a) cause any investigations to be conducted as to whether any person, corporate body or organization has committed any offence under this Act or other law relating to economic and financial crimes.
“(b) Cause investigations to be conducted into the properties of any person if it appears to the commission that the person’s lifestyle and extent of the properties are not justified by his source of income.”

It says "cause investigations!! It is only after investigation and if any tangible proof if corruption is found that the EFCC would arrest and prosecute!! The burden of proof is on the EFCC and not on the accused!! Patience has already explained she made her money from gifts showered on her throughout the 16 years her hubby was in power. It is not enough for the EFCC to say its false rather they will have to prove how she stole the money from government, from which government agency and when it happened!! That is how the law works

The state cannot seize any money without any court order. It is not you that will determine what is enough proof of ownership but rather the courts!! After the conviction of the fake directors the EFCC asked the courts to order the forfeiture of the money to the FG but the court bluntly refused to accede to that demand

Oga again I must ask you, has Patience Jonathan reported to the EFCC? Were you there when she did? Did you see the statement or affidavit she swore to? When did this happen?
From the way you're carrying her matter on your head, its like you're close to her? In case you are kindly tell her to report to the EFCC office in Portharcourt (which is close to Yenegoa) to explain the source of the money in an account (which is not even in her name) that she's laying claim to. Least we forget her only evidence of ownership of the account is the Platinum card in her possession.

Yes but by what means?
By securing a conviction in a court of law.something they have so far not managed to do.
If you take that section in face value ask yourself why did they not seize all that those quoted as returning huge sums own ?
You see where I'm coming from?

I think the word you're looking for is Interim forfeiture. The EFCC can do that pending the outcome of your case in court. Badeh's houses in Abuja for instance are under interim forfeiture. Same as diezani, bala Mohammed et al. It is more or less a seizure as the owners will bit have any form of access till the court makes the interim forfeiture a permanent seizure and claim for the state.

The justice case is not a difficult one.
What needs to be done is to reconcile his monthly earnings + any other legitimate businesses he owns and see if all the millions found in his possession correlate.

It shouldn't take a rocket science to determine his case. Also he is a public employee all his earnings should be made public.

Lolz is there any law in Nigeria that says judges should not be engaged in other legitimate sources of revenues besides their salaries?

Almost all their cases are very easy! The DSS in a statement claimed that almost all the arrest judges had not touched their salaries in months if not years. So explaining the source of the millions and billions in their possession will be a miracle for them to pull off. Nguwuta will definitely go to jail. He also has to explain the mulyltie diplomatic passports and tampering with evidence during his administrative bail.

Freezing or interim forfeiture means nothing as the properties will return to the accused if they are acquitted. The government can't make use of such monies as long as litigation is still on

I ask again is there any law that stops judges from engaging in other sources of revenues,? Justice Ademola for instance is from a very rich family ,I know another judge said he was involved in rice business. Is it against the law for a judge to save his salary and survive on other legitimate sources of income?

A judge cannot work any other job while on the bench except farming. Its even common sense. No need to quote anything. Even after they retire, they can only farm and serve on the board of commissions. Nothing else.

My dear which law exactly is that? Hope you don't mind quoting such laws!! BTW in court the onus is on the prosecution to prove that the accused committed the crimes !! It is the responsibility of he who alleges to prove!! That is the way the law works.

In law you do not assume anything, you must prove your case beyond reasonable doubt

BTW Patience Jonathan has given explanations for the sources of the money found in her account, it is now left for the EFCC to prove and convince the court that the money was stolen from govt coffers with irrefutable evidence

What useless explanation? she said the money was a gift by who make she name those wey give am the gift or are they ghost?

This same government explained how Buratai (who receives less than this justice officially) bought Dubai properties with his "savings" that is more than his 100yrs salary (and he has not served up to 30).
Burutai declare his assets to the CCB but the Judge never did, Burutai only have one passport why the Judge has 4 passport with different names. what is more criminal than for a Judge to have 4 passport with different identity please if a case of such was brought before how will he judge the person?
