“They are not entitled to immunity from litigation for actions not germane to their work. For example a president or governor who buys a car for a child and refuses to pay can be taken to court while in office,” he said.

“Also like in the US, there should be no immunity from criminal investigation or prosecution for crimes committed either before or while in office.

“Recall that Mr. Spiro Agnew while a sitting VP under President Nixon was tried and convicted for tax evasion while in office. Bill Clinton as a sitting president was hauled before a grand jury by Independent Counsel Kenneth Starr for perjury (lying under oath) while in office as president.

“Finally, Elliot Spitzer as a sitting governor of New York was tried and convicted for illicit solicitation for sex”, he added.

The sponsor believe that if the amendment is passed, there will be sanity, transparency and accountability in the Executive Arm of government, especially “Treatment of our state resources which most of them currently treat as slush funds”.

Going by the proposal, I think this is a good move. I hope people would take time to read the passage before commenting or mentioning my post.

If a governor or President has used his office to influence people to do evil or take law into his own hand, he should be sent to court and bear his own cross.

With this, people in power would learn decorum. I hope this would be well-managed so that it would not disturb their constitutional duty nor disrupt government business.

This will be the first sensible bill passed by the Nigerian Senate.
We know its for their own selfish purpose to get at the Executives but at least it will impact positively on the general society

I beg to differ from your point. Speaking of following terms in law or what the law clearly postulate, public office holders in Nigeria come short.
EFCC, DSS etc. work on president orders here in nigeria, and not indepently. Personally, I think Nigeria hasn't come up to that level.

DSS or whoever can work on presidential orders but they still have to go to court,and in court if this bill ever becomes law,it will only apply to all sitting office holders and those to come. It can't act retroactively. The lawyers can confirm though.

This is exactly what I have always envisaged. Thank God, its almost coming true. The immunity clause has long been a barrier against transparency and accountability. Its removal is long overdue....

Kirikiri might be too far to call, as many of them--deputies and governors--would end up betraying one another in the aftermath of the law taking effect.
