The EFCC act says the chairman should be presented to the Senate

The constitution says he shouldn't be presented

And whenever the act and the constitution clashes, the constitution gains preeminence....

When they know this, why do they keep sending his name to the Senate for confirmation??

The Magu brouhaha thing may actually be a false flag operation tongue used by the executive to understudy the Senate to know those who will stand with the presidency when push comes to shove.

Since at inception when the president refused to interfere as to whom emerged leader of the senate...in order to project a front of being a repentant tyrant but now a democrat...which has come to bite him in the as.s, have learnt his lessons hence using Magu confirmation to instigate unrest...and pull some certain strings...

.....students of political science....over to you to analyse this conspiracy theory undecided

The EFCC Act is a subsidiary legislation to the Constitution,it does not in any way conflict with Constitutional provisions.Nowhere in the Constitution is there mention of EFCC,how it's to be structured and its leadership appointed. That part came under lawmaking powers of the NASS.
Simple Govt 101 and our VP failed it.
I wonder which law school the VP and Falana attended and what grades they came out with.

God bless you my friend.

Because they don't want to disgrace and make them irrelevant.

Who is the idiot? EFCC is recovering looted money. EFCC is gaining convictions; including recently, a former governor and subsidy thieves. The judiciary is slow, due partly to the amount of money and power available to the corrupt politicians. They have enough money to even buy the way people reason, educated people, including you. It is good that we have a President with string character. Nigerians are now fully informed

retaining Magu as EFCC bos will actually weaken the EFCC as an illegal shiaman cannot legally prosecute anyone in court.
What makes him illegal?... A bunch of national revenue gulping rogues in the NASS dont want him, is that what makes him illegal?

Like has been pointed out a few times, he can keep being the chairman of efcc in acting capacity FOREVER cos the constitution of your country doesnt specify a maximum timeline to which a person can be acting. Secondly, there was no need sending his name to the NASS for confirmation in the first place. The efcc act says he should be sent to NASS for confirmation, but the constitution states otherwise; and when there's a clash between constitution and any other laws, the constitution takes precedent.

So I ask again, what makes him illegal?... is it cos some fat bellied shameless rogues who swallow 25% of the nation's recurrent budget dont like him?

According to the VP, i think it was Falana that opened their eyes to it. I know anytime Falana talks, the Government either gains from his speeches or receives good information from his so called outbursts.

I just don't know why Buhari didn't pick him as Attorney General of the Federation.

The Federal Government should head to the Supreme court for interpretation instead of making Magu look like the only qualified person out of 170million Nigerians that can manage EFCC. As for Falana anything he says or write i take with a pinch of salt. He has, so far shown that he is more conservative than progressive as far the law is concern, his era is ending.

because he is not a politician and has no god fathers?...you don't get political position just because you are good, you have to bring something to the table.. Unfortunately falana didn't support the APC govt into power

President magu to be re presented again, how much time do this people think they have,if this apshit govt can spend much of their time on restructuring Nigeria the better for everyone.
If they like let them confirm president magu as long as we still have criminals in the apshit govt it is a waste of time.

Thank God for democracy . The law is there to guide all through. Senate wanted to rubbish the judgement of a disciplined president but the law has come to his aid. God bless the erudite Vice President for coming out to show us vividly what the law says on this very important subject matter. No wonder Papa Sageh was very furious with the senators decision . Knowledge is light indeed. I have always known that Osinbajo won't sit down & watch the president making an avertable error. Magu is really fighting hard to eliminate or refuse corruption in our society . We are watching and praying hard for you all. The saboteurs are angry but they will never succeed over you in Jesus name. It is evil that bows before the good, the wicked must bow at the gate of the righteous .

English is difficult! He said there was no need for Magu to have appeared before the Senate, since constitutionally it is only Ambassadorial and Ministerial nominees are compelled to do so. This means Magu's name only needs to be set to the Senate, he need not appear before the Senate. Kai!!!

If the EFCC Act is in conflict with the Constitution, why not abrogate that part of the Act? In any case, you want to continue presenting him again and again and again and again while the DSS and the Senate continue to say NO. And, meanwhile, he continues performing as the Chairman and nobody sees nothing wrong with that. SMH. Most of our so called "lawyers" are not reasonably logical?

Osinbajo is twisting the law to push Magu forward.

Wow
I have every reason to believe that the VP is the force behind all the judicial impunity of PMB's administration.

The constitution is the number font erigo, point taken. It also sets up the organs of government with powers to function, such function must to be in line, and NOT IN CONFLICT WITH THE CONSTITUTION. This is the basis for judging all that the VP is saying here.

The question now is; "is the EFCC Act made under and in compliance of the constitution?" The answer is in the affirmative.

The constitution needs not be exhaustive as to how to appoint all the heads of government parastatals. That's why the NA made laws for all agencies of the FG, and the VP just picked out one to castigate because he and his boss couldn't have their way with Magu.

Osinbajo should not be the executive and the judiciary at the same time. I wonder how he wants to keep interpreting our constitution like he wants.

As for Falana, I don't know what to say. He plays his pipe for the highest bidder.

Pdp stalwart !
We all know Femi Falana And Professor Yemi Osinbajo as authorities in law.
