The title is simply "acting president", while his function is to coordinate. The president merely defined the function of the seat. Seems some people need to read more on language use.

I don't understand your argument. So, if someone goes to court today against the acting president, will the legal action stop Osinbajo from acting?

We should stop over flogging a non issue. Buhari had complied with section 145 of the constitution and that is what really matters. All other grammar after the first paragraph of the letter are irrelevant turanshi.
get it,that letter was deliberately drafted as we all know buhari is not himself and in the state of mind to draft such letter.
A coordinator is someone chosen amongst other equals to oversee activities of the generality ,a good example is the coordinating minister under GEJ .
As it stands osibanjo is equal to other federal executive members and that is how they see him,you don't even have to go to court for interpretation as other members of the executives will only see him as the coordinator of govt than acting president.
You people should be happy that there are bold people such as Mao ohabunwa who can point out such craftiness and illegality even in the face of tyranny.

Yes, we know that. But you don't know how mischievous lawyers hing on things like this to buy time for their clients. Look at the Dasuki case, look at PEJ's case...its smart pants lawyers delaying justice.

Now let me me remind you of this case; The late Yaradua suspended payment of subsidy on kerosine but it was later discovered that Denziani was still looting money in the name of payment of subsidy. Her explanation was that Yaradua's order was not documented in the weekly gazette and so was not implemented. Now that is as far as mischievous people can go.

If for instance Osinbajo was the one that gave such an order and a minster ignores it secretly, when it is blown open, such minister may hinge on this to say that the presidency gave no such order and head to courts to delay justice.

We shouldn't give room for such occurrences. We, the innocent peeps understand that by virtue of section 145, Osibanjo is the acting president. But to avoid irrelevant legal tussles, such things should be plainly stated.

I tire oo,What is the noise all about, the opening paragraph said "in compliance with section 145 (1) of 1999 constitution......". Let's step back and see what does the section say before we start yelling and shouting. The section stated that once the senate receives a letter from the president informing them of his vacation or leave, the Vice President will henceforth serve as the acting President, until the president returns.

My question, is buhari not referred to the section that empowers osinbanjo as acting president??

These fools need to see the copy of the letter b4 yearning gibberish here and there....

You are the one yanning gibberish Becos u knw nothing about interpretation of an instrument neither do you know the cannon of interpretation that states " the express mention of a thing excludes the other". Like the writer whom u replied said, whoever goes to court on this issue knows the possible outcome. The issue is not that naming the VP a coordinator voids wat second 145 says, the issue is giving room for any person to construe otherwise.

The first letter with acting on his behalf does not Bear constitutional quote.

Why did he quote constitution and name it coordinator.

This means that VP does not have the full potential as president.

Some ministers will travel to London for singing or approval of documents.
In the name of coordinating. Nonsense.

Section 145 :
‘Whenever the President is proceeding on vacation or is otherwise unable to discharge the functions of his office, he shall transmit a written declaration to the President of the Senate and the Speaker of the House of Representatives to that effect, and until he transmits to them a written declaration to the contrary, the Vice President SHALL perform the functions of the President as Acting President.’

Buhari cited that section of the constitution amd transmitted a letter
----------------------------------------------------------------------------------------------------------------------------------------------------------------

Once again blinded by tribal sentiments, these cowards refuse to decode 'Buhari's' letter.

The president is NOT ON VACATION. Secondly, he NEVER said that he is "unable to discharge the functions of his office". This makes nonsense of this section 145 you guys keep quoting.
He travelled out for a medical check up. Do I need to explain more. His letter left a lot of loopholes.

Mazi, stop getting worried over a non issue. Osinbajo is the acting president and he will exercise the powers of the office of the president till Buhari returns.

The powers of the president is derived from the constitution and not the choice of words of the president. Once the constitutional provision is satisfied, there is no problem.

You are the one that failed to read or digest my point; maybe because you have comprehension issues.
Read my 2nd paragraph again...carefully this time, especially where I said that we all know what the constitution says. You have zero idea what some mischievous people can make out of that letter which is open to different interpretations.

Its difficult trying to make a point these days; everyone is clouded in the veil of either religion of tribalism.

stop confusing urself, make i help you, take dis

The president on its own has no powers. Its powers come from the constitution. Which is the collective will of the people. In the event of him vacating the office due to temporary illness. The constitution itself has spelt out measure to be taken not the president.

That's is, it is not a matter of what the president say he is, rather what the constitution says on this matter.
Coordinator, were does that thing come from. If the president is not acting, the vice takes its place. That's the reason he is vice.

So going to court for some nonsense wont even work in d first place

Just like I said in the other thread about this controversy...

You guys don't understand the point Mao Ohuabunwa was trying to make and I am with him on this. The letter is ambiguous and open to various interpretation.

Yes, we all know what the constitution says and in view of that, Osinbajo is the acting president. But look at it from this perspective: He may give an order or sign a law or budget and someone somewhere will go to court challenging him on the signed law insisting that he was not the acting president and lacked powers to sign such all in a bid to buy time. Please note that the person challenging this knows the outcome already but would want to buy time. He will seek interpretation from the lower courts, then appeal the judgement, and later head to the supreme courts with various court injunctions inbetween and before you say jack, 2 years has elapsed and the culprit is still free because while he is at the courts, all actions will be pending awaiting the court verdict.

This is the lacuna Mao is trying to bring to light. After Osinbajo signs the budget, someone somewhere will spend above the budget next year or next 2 years and when EFCC wades in, he will go to court to buy time, hinging his case on this same thing.

Do not forget that Ngozi Okonnjo Iweala was coordinating Minister under GEJ and we know theirs no powers attached to such portfolio.

The letter could have been innocently scripted, otherwise, it could have been crafted by some mischievous powers surrounding the presidency. Mao is not ignorant of what section 145 says so he knows exactly what he is saying; we call him "Ancient Mao" in Abia North and we have a saying that what an elder sees while sitting down, the youths will not see even if they climb the iroko.
ancient mao...according to section 145 which the president reffered to in his letter osibanjo is clearly the acting president till otherwise, fools would always argue over nonsense when there are more important things to address like should hameed ali put on uniform or not? when our borders and ports are leaky...but this omokri is only seeking public attention, btw omokri means goat in my language

The choice of words used by those that crafted the letter in the second paragraph is irrelevant. Osinbajo immediately became the acting president immediately the senate president read the first paragraph and until another letter is sent to the senate that Buhari is ready to resume, the powers of the office of the president remain vested in Yemi Osinbajo.

Was the constitutional provision satisfied?!. The president never transmitted a letter to the effect that He is unable to discharge the functions of his office. This practically means he can run things from London via his inner circle(Cabal).

The problem here is that we would not know if the president is the one ACTUALLY running the nation or members of his inner chamber.
Re: Osinbajo After Reading Buhari's Letter - Reno Omokri (Photos) by tinsel: 10:10am On May 10, 2017
I dont know why people waste there time on none issue.
As per the constitution all Buhari is needed to do is write a letter to the national assembly that he is going on vacation. Automatically, the vice president becomes the acting president. He does not even need to mention the vice president any where in the letter.
PDP is pathetic. They can never get over the lost of the election. And unfortunately no matter how they cry, they will never also smell the office of the presidency again in Nigeria.
