*Surrogacy gone wrong*

Miss A gave her egg to Miss B who carried the pregnancy for 9 months and both had an unwritten agreement that the baby would belong to one of them but after the birth of the cute baby both refused to honour the agreement but each was sincere about the owner of the egg and who carried the baby in the womb for 9 months.

Please help us solve this matter...who owns the child.

There is no issue with the paternity as that is clear but who should be the mum?

The lady that went through the stress of carrying a developing child for 9 months or the one that just provided that tiny egg...

Biologically, Miss A is the "owner' of the baby. Legally, one would have to refer to a contract to see if miss A decided to donate her eggs and waive further rights, or miss B decided to act as a surrogate, for whatever consideration.

Surrogates have no claim, whatsoever, since it isn't even their genetic material that's used to produce the child. But it doesn't stop them from developing a bond with the growing fetus, which makes the eventual separation every bit as painful and depressing as though the baby were actually theirs. What is the essence of motherhood, truly? Siring a child or nurturing one? The bond of mother/child is made especially strong for those nine months. Do women who use surrogates miss out on that connection? Just thinking...

The biological mother- the egg donor
For the surrogate to claim paternity the biological mother has to relinquish paternal rights and this is decided by a judge.
The father will have to be drafted into the picture unless donor sperm was used.

I think Legally, the owner of the egg is the mother. same as biologically.
The surrogate is just a womb borrower.
They don't have this kinda problem abroad, they know the rules. smiley

It's like you don't really want an answer cause you are quoting those that are giving you answers I think you don't really want to hear. I might be wrong but I feel you are involved in the issue.

Truly, the woman who carried the baby nurtured it and went thrthroughthe pain of giving birth to the baby but since she had already given her word even it isn't written, she should keep it. The one with the egg deserves to keep the baby because before the whole thing, they already had an agreement and not forgetting the baby carries the DNA of the egg donor.

To the woman who carried it, tough luck. Before you decided to accept someone else's sperm and egg to be fertilized and carried by you, didn't you know there was a possibility that you will grow attached to the baby? Didn't you know all about being a surrogate mother? You gave your word and had an agreement with the egg donor and you should keep it no matter what, even if there is no contract to prove it. You made a choice, now it's time to face the consequences.

I was only reasoning out the answers which is a very logical way of doing things.

These two don't have any agreement as it stands so referring to that agreement is just like trying to refer to a non existing matter

What I'm asking is that how will you solve the matter with the present situation.

Baby belongs to A. Simple. B is just fermenting trouble. Most surrogates are paid to do that, so she shouldn't lay claim biko.

My advice: Miss B shouldn't fight a lost battle. She should just find a way to remain in the baby's life by entering into another agreement. Even if its just visitation rights...atall at all na winch market.
