Its simple reason. He tend to insist on killing corruption, fighting corruption. Fighting corruption when done sincerely, 80% of the senate will be implicated. They can't bear the thought of not stealing from people hence their rebellion. They will rebel against anybody that try to change their ways regardless. So its understandable that he couldn't control them .

Confirmation of the chairman by the NASS is not a formality, that process is there for a reason

You can not go to senate for confirmation and when you don't get that confirmation for genuine reasons you now then turn around to say the process is not required in the first place!

All actions taken by the Magu EFCC will be successfully overturned by the courts for lack of legitimacy

“The offices to which this section applies are, namely,
(a) Secretary to the Government of the Federation;
(b) Head of the Civil Service of the Federation;
(c) Ambassador, High Commissioner or other Principal Representative of Nigeria abroad;
(d) Permanent Secretary in any Ministry or Head of any Extra-Ministerial Department of the Federation howsoever designated; and
(e) any office on the personal staff of the President.”


Section 171 is very clear,...just read through paragraph 'D'.
Since the president cannot CONFIRM the appointment himself and the senate can't stop the appointee from acting capacity, so the Presidency is on track by leaving magu in acting capacity. the Presidency plan is to have magu in acting capacity till 2019, funny as it sound, this is the constitution of Nigeria...
BTW, why can DSS just come out and take magu to court since they say they have evidence.

But as it is right now Magu remains ACTING EFCC CHAIRMAN, and there is nothing saraki can do about it.

After Commander Fayose, Saraki is the most feared man by APCheat. The guy is really giving them heart attack. They know if they don't quickly cage him, either by blackmail or intimidation, he is unstoppable.

This issue is very clear let the Senate head to court over this issue. The constitution itself is contradicting itself.

The senate is standing on the 152/153/154 section of the constitution together with the EFCC act,which say the Chairman should be confirmed by the senate.

The Executive is holding up the 171 section of the constitution that the EFCC chairman is an appointee of the Presidency.

But my own personal opinion is that Magu can remain in acting capacity without the approval of the Senate. Only if Magu is to be a substantive Chairman then the Senate has to approve it, but as it is I stand with the Executive.
