Quoting the wrong thing. EFCC boss isn't a Minister. He isn't an FEC member.

EFCC bosses have historically been sent for Senate confirmation but that doesn't mean they had to be. The constitution doesn't say they have to be. Past leaders didn't act based on the constitutional provision. Obviously the admin thought they needed Senate clearance but after the rejection they did their homework and found out that they didn't.

The chairman of EFCC is the head of an agency under the supervision of ministry of justice and hence cannot be on the same level with the minister.

The section of the EFCC act that provides that the chairman needs to be confirmed by the Senate is inconsistent with section 171 of the constitution and therefore null and void to the extent of the inconsistency.
