This section talks about appointment of ministers and the EFCC chairman does not fall into such category. Go and read section 171 that gives the president the powers to appoint heads of government agencies without recourse to the senate.

The NASS is the body with oversight over the EFCC

Confirmation of the chairman by the NASS is not a formality, that process is there for a reason

You can not go to senate for confirmation and when you don't get that confirmation for genuine reasons you now then turn around to say the process is not required in the first place!

You people need to learn to follow the rules!

All actions taken by the Magu EFCC will be successfully overturned by the courts for lack of legitimacy

You are wrong, Magu is an 'Acting Chairman' and not the 'Chairman'.

There is no law stating how long he can act, neither is there a law indicating that, if the Senate rejects his confirmation he becomes illegal.

The Nigerian constitution is silence here, so the Senate does not have a leg to stand, should they go to court. Plus, the constitution did not say Senate should confirm people working for the Executive in 'Acting' capacity.

This is a glaring loophole in the Nigerian constitution and absent of a law forbidding it, the Executive branch is not out of line to continue the appointment of Magu in the acting capacity.

The US constitution recognizes this loophole and blocked it by stating that, the President can only make appointments without Senate confirmation, when the Senate is on break or recess and that such appointments must be confirmed by the following year or the position revert back to been vacant...which means, one can only be in acting capacity for a max of two years.

Saraki won't be president.

Senate President gets another report from DSS indicting the same guy.

Senate rejects...


Presidency blames Senate and call them names but didn't talk about the DSS report,


Instead of cleaning their mess and putting their house in order

They resubmitted the name, and DSS submitted a more damming and detailed report to discredit him,

Senate rejects, presidency cry wolf and say Senate don't even need to confirm...


N. B - DSS is under the presidency and the director is an appointee of the president...
