I experienced this last December, but though I was given 3months interval to park out. those of us that our rents hasn't expired before then we collected our balance and we find our way out. na abuja though, maybe your own place fit de different sha. my advice, go to the police, they will settle you guys ones and for all. |

9jakohai: Hmmmm pls i also needs your advice. since two years ago when a man who stands a an agent parks out of my area. well this is what happen, our landlord is dead, now his house was given to his best friend who is living opposite us to manage since his 2 wives can not read or write. when i parked into that house it was this his friend i paid to, and i have been paying since then until two years ago when the man decided to park out though the house belong to him. now my landlady presurized me to continue to pay her since we dont know the man wereabout, which i consented and being paying since then without any written letter or a reciept. Your landlord is trying to make you uncomfortable, even if the house was sold the new owner cannot forcefully evict the sitting tenants without court order which will require a minimum of six months. Just tell the co tenant sent to you that you will gracefully wait for the new owner. Meanwhile try to find out what is really going on from various reliable sources. The landlord knows that he can't evict having came in through the recognised caretaker. Find out if that caretaker have power of attorney in respect of that property. From there you should know your stand |

Princewell2012: AM not an expert....but I think you should meet the landlady and get a written agreement, prepared by a lawyer...which you sign....stating terms and conditions. If you cannot get that written agreement...better move out....and get a better place.With a signed agreement in place. |

xcommando: Firstly, what do you want from your landlord and caretaker? Refund of monies paid, relocation to another suitable property or a longer time to enjoy the property. If the property is in Lagos, contact the Citizens Mediation Centre. If it is in any other state, contact the Citizens Rights Department of the Ministry of Justice. There are lawyers there who would mediate on your behalf and try to settle it based on the principles of equity and justice and for free too. I suggest you talk to the landlady and let her know that you're not against her selling the property, but it's wrong to do so with sitting tenants on the property. Tell her that you made payment to her validly appointed agent and she didn't and as at when you paid, there was no notice that the agent was no longer representing her. Now, tell her what you want. Either a refund of your complete rent or a longer notice. Tell her you have spoken to your lawyer and they want to take the matter to court and put an injunction on the property but that you want to speak to her first and see if she's a reasonable person before you proceed. Whatever you do, be very fair, firm and just as you'll be a landlord one day. 2 Likes |

My say on this. First, you made a mistake by not signing a tenancy agreement with the landlady. That is aside for now. Secondly, if the receipt given to you has a fixed tenancy period stated on it, you are are covered because agreement can also be oral (parol). If you paid for a full year, you are a yearly tenant and should be given 7days of owners intention to recover possession. Mind you, you are not entitled to 6months notice because your tenancy should be tenancy for a fixed term according to Lagos state tenancy law 2011. In view of the above, your landlady has no other option than to wait for your tenancy to elapse before quitting you unless she wants to use force which is against the law if you know your rights. If she wants to sell her property to another person, she can do so while you are in occupation and you become the new owners burden. To cut the whole thing short, contact a lawyer to write to her on your behalf. She should settle her issue with her estate agent. Thank you 1 Like |

When ever you are going into any contractual agreement with a person, make sure you receive a receipt or acknowledgment in respect to the transaction. When next you are paying her, ask her for receipt or written acknowledgement evidencing receipt of the rent duelly signed by her. Continue to live in the house if you are comfortable living there, but don't forget to collect receipt next time. Thanks Princewell2012: |

abelee: Mediation center only mediated between landlord and tenant. They can't enforce judgment except through a court. So it is magistrate court that is in best position to handle tenancy issues. |

xcommando: strongly suggest u meet other tenants and focus on the recovery of the rent u paid the caretaker, threaten him wit police action and arrest. am not sure u will stand the stress and rigorous activities involved in premises recovery if u dnt hv the financial means to hire a lawyer. and there was no agreement bw u tenants and the landlady and no way to prove the caretaker had the authority of the landlady through a power of attorney when the house was leased, u see the difficulty? if there was an agreement and u can prove the caretaker was still in her employ then the court will protect u if not channel ur energy on recovering the rent u paid |

F fashrola: On issue of agreement. Lagos state tenancy law 2011 section 3(a),(b),(c) states that agreement can be express or implied, oral, written, partly oral or partly written, for fixed term. Section 5(1) states that any landlord or agent acting on his/her behalf shall issue a receipt upon receipt of rent. Section 5(3) says the defaulter is liable to fine of #100,000. I know our legal system is poor but I pray OP resolves his matter amicably. |
