The constitution did not envisage a sitting President to be away for so long so there is no 90 day ultimatum clause in the constitution. Rather what is being bandied around as 90 day ultimatum exists in the civil service which puts medical leave at no more than 90 days before which a medical board will be setup to. In the case of setting up a medical board, the constitution only mandates the Federal executive council through a motion moved by the AGF furtherance at which a medical board will be set up and headed by the serving minister of health. The final findings will then be submitted to both houses in NASS for deliberation from where the President will be removed after only a 2/3rd vote majority is attained. It is not in the hands of NASS rather FEC. One would have expected that the Senate would have amended the section of the constitution regarding the likely incapacitated health status of the President drawing examples from the Yaradua saga. 8 Likes 2 Shares |

dlondonbadboy: This was what Aandonka the then minister of Justice under Yaradua refused to do and only Dora stood up to demand that the FEC setup a medical board. This is also another reason Tinubu was pushing for Falana to be appointed minister of Justice and was bent on controlling both houses in NASS in the event that he could easily have removed Buhari by now. But I killed his ludo moves here by creating series of threads warning Buhari and the CPC faction not to allow Falana as minister. He can only be impeached if he didn't hand over power which he did But all the same I think the Constitution should be amended. There should be a stipulated time a president should be absent, hence he risks impeachment. One person shouldn't hold the country to ransom for so long |

iaatmguy: No! Buhari is long overdue for dereliction of duties and abstention. The only problem is that the constitution places the onus to implement impeachment procedures on the FEC after which the National assembly can fully take over. But with the reality of the Boko seats in both houses, even if Buhari is declared clinically dead, the bokos will oppose any move to remove Buhari all because it will be a waste of 9yrs of jihad that saw that bigoted clown ascend to power. The law is an ass and that means we must ride it through this rocky treacherous path. But the only reason nobody is clamouring for Buhari's removal is because of that man servant stooge and the loud mouthed Yoruba cowards he represent who I must add have suddenly grown quiet. 1 Like 1 Share |
