During trial the defendants lawyer supposed to hv done the needful..

You see the Afoloyan has no moral right to detain another person's property permanently, he can only detain the cattle till the police force is able to register the incident. He broke the law simple.

The gravity of the judgement is another matter but that is the judge's prerogative
I'll like to read the judge's concluding statement

If you kill someone on your farmland I do hope you can defend yourself in court. Your only option would be protection of life and/or property in the face of imminent danger and that is very hard to prove or disprove . God help you.
You shld spend that money installing steel poles and barbed wires round your farm

Now I think something is wrong here....

No-one addressed his loses BUT he took laws into his hands.
Force doesn't win all the time.

One commissioner of police under Governor Lam Adeshina once lamented on the fulani situation - on the difficulties experienced arresting them as they are always on the move. They commit crime and move somewhere else
That is the point!
Even when you want to legally pursue the case where and How do you serve them with the court notice, when they are always on the move.
God help us all.

The navy officer should also sue the Fulani to court for destroying his crops. I am sure he will win, if he also has enough evidence.

The navy officer couldn't have won the case because he was guilty of offense he was charged.

Why bring ethnic sentiment into a civil case? hmm

Frustration is not a good reason for breaking the law. we have several levels within the judiciary if you don't get justice here try an higher level, ensure you have adequate evidence. Nothing stops him from equipping his farm with fencing or camera systems or adequate security to prevent such.

I live in Ireland and deal with farmer frequently who have cameras and sensors on their different farms because of theft or vandalism; there was a case of a farmer sometime ago who shot a thief on his land and went to jail he almost lost everything I think he got 4 years
I agree with you, frustration is not enough reason to break the law. However, I'm sure he had no plans to permanently confiscate the said cows and he had to detain them as exhibit...this is naija, CCTV cameras are hardly functional in the cities, least of all a farm where they prolly have erratic power supply.

Let's be real here, this judgement was malicious and a warning to others who may want to disturb Fulani herdsmen. We have heard of Fulani cows breaking barriers and barricades to feed, so the issue of fencing his farm is not applicable.

There is nothing malicious about the judgement, yes the system has failed the respondent however the failure of the system is not a good reason for violating the laws.

He had legal recourse and that option is never off the table no matter how many times he fails he needs to keep trying. The farmers need to also set in place protocols and be in agreement with the local security apparatus

The owner of the cows went through a legal process to seek justice, and that's quite commendable. Quite certain he didn't choose the violent way because the ex naval chief also have armed guards at his disposal.

Now the farm owner can sue for the damages done to his farmland. Let's see how the court handles that.
Here's the first piece of farmer-cattleherder dispute that didn't end in bloodshed. Nice!
And will it go to his favor? BTW, the farmer only seized the herders cows. He did not even kill one.
The court should have looked into his claims .

This judgement throws a rare insight into the ongoing conflict; where only one side is being heard; had this Fulani man not had the knowledge and means to take him to court, the outcome could have been quite different - most likely very deadly.

The court must have clearly weighed all the evidence before it and judged that the Navy General (with all his connections) in the wrong in awarding the Fulani man damages.

I am sure this is now paining many of the hateful wailers as judged by their usual irrational obnoxious comments. grin

You agree that the system has failed. Have you heard of any herdsmen paying for damages against farmers?
This same thing happened to OluFalae, it happened to several others . What has the government done?

This humiliation is getting too much.
Yoruba the Igbos don't hate you, Igbos the Yorubas don't hate you. We only view things differently when it comes to politics.
Niger deltans now you know who is after your oil.
Time has come to put our differences aside and fight the real enemy.

Niger Deltans have always known who is after our oil. They are not even after it. They are sitting on top of it.

2015 was a peculiar time in our history, it was the South's chance to unite and give the North a middle finger. We lost that chance, it'd be a couple of decades before we get that chance again.

Those who felt 2015 was about access to access to Aso Rock or unrealistic Elysian principles can now see the damage in full.

Unfortunately, Southern politicians don't really care about most of these developments. Tinubu is still with Buhari because of VP position (or a 2023 presidency shot), Wike is all about becoming a godfather, Obiano isn't sure of what he intends to do on the national stage.

When our most formidable Southern politicians are those names I mentioned, you really begin to see how f*cked up we are. Southern unity died in 2015. We've done the burial. I don't care about it anymore. We'd lose a lot before anyone would think of seriously resurrecting it.
