See justice for Cow and injustice for the Admiral. Let the Admiral determine to pay them N100 monthly. He will complete the payment in about 200 years time.

That judge is a mad man. Navy officer should take the case to a higher court.

See how fast the judgment is. Awonoloriburuku. I thought Fulani herds men are invincible. Who took the case to court?. It is now clear that this Fulani wahala is big men vs the common person. Everything in this country is gradually pointing to her ending.

Soon APC government will build and furnish duplexes for cattle, not just building a colony. And establish a court to handle cattle cases and pass judgement in favour of fulani herdsmen.

Welcome to the cow country... Your fulani herdsmen induced damage is irrelevant and inconsequential, only detention of the cows and he's to pay 9m while the man that did actual damage is to walk free. Lol

By Musa A Bello (The Insightful Observer)

Human as a complex being has been studied throughout all ages, yet a lot about him still remains mystery. Be it behaviour, the body form or the soul. In all these, One fact still remains a universal truth; "The desire to fulfill his personal desires above the needs of others".

Self-centeredness is indisputably an innate nature of man, nonetheless many have developed the ability to suppress it's manifestation, though they are the insignificant few. Many problems plaguing humanity are mostly avertable if self-centeredness is put into check, particularly here in Nigeria and this is because self-centeredness, like a cancer spreads uncontrollably and leads to various antisocial vices such as imperialism, corruption, nepotism, tribalism, racism, bigotry and religious fanaticism. These aforementioned vices are the genesis of problems disturbing the world today, particularly Nigeria and Africa in general.

If a person understands that, his beliefs which he holds dear as the absolute truth to him might be relatively erroneous to another, he develops tolerance. Also, if a person understands that his position of power is to serve the general populace not gratifying his own personal desires and interests, then corruption will not rare it's ugly head. Furthermore, if a person understands that good character, attitude, knowledge, qualifications and other meritable qualities should be the criteria for considerations, surely corruption and nepotism will be words only in the dictionary.

Finally, the desire to benefit humanity while finding balance in one's own personal needs and interests should be a moral obligation upon all. The best of men are those who benefit humanity.

The owner of the cows went through a legal process to seek justice, and that's quite commendable. Quite certain he didn't choose the violent way because the ex naval chief also have armed guards at his disposal.

Now the farm owner can sue for the damages done to his farmland. Let's see how the court handles that.
Here's the first piece of farmer-cattleherder dispute that didn't end in bloodshed. Nice!
True! wink And I also hope the naval officer appeals the judgement, at a higher court. It would be interesting if the case gets to the Appeal court, and the judgement is overturned, and the high court judge is reprimanded.

Other reports actually said that Afolayan arrested the herdsmen whose cattle damaged his farm crops, and reported them to the police. The naval chief probably knew that if he handed over the cattle to the police, they would immediately hand it over to the owner, and the matter would die a natural death. Anyway, while the herdsmen were in police custody, they gave out the name of their sponsor or the cattle owner, who was based in Zamfara. Afolayan was said to have detained the cows waiting for the owner to come and pay for his damaged crops. The police declined to invite the cattle owner for questioning, claiming that he was too powerful.

Next thing that came up was a law suit.

Court orders Afolayan, ex-navy chief, to pay N9m to herdsman for seizing 42 cows

An Ilorin High Court has ordered a retired navy chief, Vice- Admiral Samuel Olajide Afolayan, to pay N9 million being the cost of damages and for detaining 42 cows belonging to a Fulani herdsman, Alhaji Abubakar Abdullahi, illegally and unconstitutionally.

The verdict, delivered on January 9, 2018, indicated that the retired admiral was also ordered to pay N500,000 for each day of default of the judgement debt.
Justice Adeyinka Sikiru Oyinloye gave the judgment in suit NO.KWS/83M/2017.

The herdsman, Abdullahi, had sought the declaration of the court that the seizure and/or detention of his 60 cows by the respondent was bizarre, unlawful, illegal and unconstitutional.

He also sought the respondent’s unconditionally release of the cows with immediate effect, and another order that the respondent should tender unreserved apology to be published in two national dailies within two weeks of the judgment..

N10m was demanded by the applicant.

According to him, security guards attached to Afolayan had accosted his son outside the farm of the respondent in Obo-Ile in Ekiti local government area of Kwara State and pointed gun at him while he was rearing his cows on May 17 2017 and seized the 60 cows.

According to him, despite frantic efforts to get the cows back, the respondent held on to them, insisting that N5m had to be paid to get them back.

Afolayan in his defence, told the court that the cows were led into his farm on the said day and destroyed his cassava and maize farm worth N2.5m while the applicant burnt his cassava processing plant which made him to insist that he must pay for the losses estimated at N15m, which was later reduced to N5m after pleas.

While delivering his judgment, Justice Oyinloye said though the applicant claimed 60 cows were involved, the respondent admitted seizing only 42.

while the fulani man was smart enough to go to court, the admiral took laws in his hands being a soldier..

the court pounced on him.
thats the only interpretation I read here

I'm not an IPOB or Hausa/Fulani but permit me to say that this is a very good development. The Yoruba asslickers deserve every bit of this because they were insulting the IPOB, Kanu and all those who clamoured for restructuring.

Do you think a commercial farm is the size of a plot of land? While spending money erecting barbed wires and steel poles round several hectares of farmland, what happens to the trespasser doing same for his cattle

It is the standard on many farms stop talking like some of us have never been to a farm before, yes it is a lot for money but it may be what is required.

There are enough young engineers in Nigeria maybe they shld device a solution that has commercial value.

I live in a country in EU where the major business for centuries was farming and still is in the rural areas. Most farmers fence their many hectares of land using wood because barbed wire is barned because of wildlife safety.

You are missing the point. This is not just a case of wild lives straying into farms. This is a case of deliberate and calculated herding of cattle into farms. Whatever you recommend for the farmers must be extended to the herders. Since you mention living in europe, then ranching should not be a novel idea. It is a standard practice

I never said ranching is not the right way forward. The state governments need to ban public herding of Cattle just as Benue has done ;Already there is an existing FG ban on herding of cattle on public roads but like many other regulations it is not adhered to . And also ensure as there is adequate consequence for flouting rules and regulations.

However anyone who owns farms has an obligation to ensure their farms are adequately secure from unwanted encroachment by using fencing.

Gov doesn't have to do it all
