Or eg he swaved to avoid a child or stupid driver

The pic appears to show the maroon car being wrong BUT what made it encroach into the silver car

This pic does not have enough details, but if you want to judge by it, there are factors to consider. See the direction of the green CRV, its faced in the same direction as the Volkswagen, then when u look through the windsreen of the silver car, u see a sedan in front heading in the direction of the silver SUV

It seems the Volkswagen tried to get in front of the silver SUV. I think the silver SUV is at fault, looking at the point of collision, its not at the driver's door nor even the passengers door, but the rear. So i think its the silver SUV at fault.

I doubt that the silver SUV is at fault, look at the tire position of the ride, it's straight meaning that the SUV guy never intended moving out of position.

secondly u don't hit a car from behind and be in that position, that's what the bumper is there for. now take a look at the Maroon bumper, it's dented from the side, meaning the SUV was in place before the incident hence the tire position and the maroon dent position.

like what zimdrill said, we might not know for sure what prompted the maroon guy to swerve like that, it could be that he tried dodging a delivery bike or a danfo or even a fellow private car owner..... or he/she just doesn't know how to drive.

It's difficult to judge without a clear picture of the road & markings therein. However, from the vague picture, the VW is at fault as he fails to maintain his lane. The silver vehicle kept to his lane.

VW Jetta clearly at fault for trying to switch lanes without properly observing for clearance. LR2 is still in its lane except one wants to fault it for driving too closely to Jetta.

I’ll go with B.

Facts:

1. There are two lanes in this picture. The green car appearing in one and the silver SUV firmly on the next lane.
2. The red VW Jetta is attempting to change lanes from lane 2 to lane 1.

Obersavations
1. Red VW Jetta rightly turned on his pointer informing intent to switch lanes.
2. Silver SUV either did not see this early enough or he did and chose to ignore or react by speeding up.

Conclusion

VW Jetta is the wrong party here because he did not ensure appropriate clearance on lane 1 before attempting the switch. Turning on ones indicator must be closely followed by maintaining safe distances before changing lanes of at least a cars length.

Clearly, the maroon vehicle is at fault. There is a rule for such manoeuvres called MSM meaning Mirror, Signal, Manoeuvre. In other words, first look at the side Mirror (M) on the intended direction to be sure it is clear and safe to turn, then Signal (S) only if it is safe to turn and then Manoeuvre (M). That way all vehicles behind are given enough time and space to adjust to your change of direction. 90% of Nigerian drivers are not aware of this. They believe just turning on their indicator lamps at any time is enough warning to other motorists. Many don't even bother looking at the side mirrors once they switch on the indicators before changing direction.

silver. American rules, you hit from behind, it's your fault period unless the person stopped and backed up. Do I always agree, no. But the law is the law. There's such a thing as defensive driving which obviously silver did not do. (Though I might add I'll probably have done the same thing wink)

Silver at fault if... maroon had the space and silver sped up to avoid being overtaken. This can happen if the silver driver was texting....leaving a gap in front...then on seeing the VW about to get infront..steps on the gas.
Insurance companies will fault the SUV on grounds that he maroon car was hit behind the front door post (hinged edge ) which means the SUV driver had seen the VW coming into his lane and had enough time to brake to avoid an accident.
Silver at fault..if it was parked...and took off without checking if it was safe to do so.
VW at fault...if he was switching lanes when it was not safe to do so.
...if the SUV was parked
...both can be at fault. ..NO FAULT! .

The VW looks to me like those driver that have the mentality of "since I put on my signal, I automatically can switch lanes". That's the average mentality of a Nigerian driver. Signalling a lane change does not mean it is safe or you're even permitted to change lanes. If this is the scenario, I am definitely the one in the silver SUV because I won't care what happens as I despise such drivers.
