Account Freezing: Akwa Ibom State Government Slams N50b Suit On EFCC by Blue3k(m): 9:00am On Aug 19, 2018

Akwa Ibom State Government has filed N50 billion lawsuit against the Economic and Financial Crimes Commission, EFCC, over an unlawful freezing of its account recently.

The State’s Attorney General and Commissioner for Justice, Barr. Uwemedimo Nwoko disclosed this to newsmen in an interview on Friday at the Government House Uyo, Akwa Ibom State.

Other defendants named in a writ made available by the Attorney general are: The Attorney General of the Federation, Zenith Bank PLC, Skye Bank PLC and the United Bank for Africa PLC.

Nwoke noted that the anti-graft agency had no constitutional powers to freeze the states government account.

According to him, “There is no basis even in the constitution of Nigeria or any other enabling law made by anybody whether the National Assembly or the state Assembly or any other convention that authorizes any federal agency or any agency to shut down the account of a state government as done by the EFCC.



”I want to state clearly that even if there were to be an investigation that the EFCC was carrying out about whether there was any fraud committed against Akwa Ibom state in that circumstance, it should be the government of Akwa Ibom that should be the victim, so there was no basis for freezing the account they claimed that they were investigating a fraud against that state government.”

On whether the freezing of the state account has any political undertone, Nwoke declined comment, insisting that he would pursue the matter legally and to a logical conclusion.

The Attorney General regretted that the state account that was shut down stalled the Economic, security and business operations in the state, adding that some prospective investors in the state developed cold feet due to that singular act thereby subjecting the state to losing billions of Naira.

”The singular attempt of freezing the account of the state government was shutting down the state. Akwa Ibom state was brought down on its knees, it was an attempt to paralyze and completely demobilize the activity of the state.

”We could not respond to economic, security and business exigencies. Most importantly, the investors that were coming to Akwa Ibom began to have a second thought and became worried about the status of their investment. Those who were on their way began to go back. so we suffered unquantifiable losses.” He said.

Nwoko also taunted the EFCC’s report denying freezing of Akwa Ibom state government account, saying that, that was a face saving approach by the anti graft agency.

He added that the state government had every evidence to prove that its accounts were frozen.

On the report of tracing about N11 billion to accounts owned by top lawyers in the country, the Attorney General said the state government had lawyers under its employment and it owed them obligation to pay them their fees, arguing whether it was unlawful for lawyers who work for a state government to receive their legitimate earnings.

What if they get favorable judgement? Who will enforce it?

There are over 2 Trillion Nigerian Naira in judgement debt which Federal Government refused or is incapable of paying.

Good settle your grievances in count not in media. If there's no legal basis for their actions make their ineptitude your payday. I dont get why EFCC would lie about freezing state accounts like it wont be traced back to them. Benue should consider doing the same.

anytime an akwa ibom man takes you to court they will win. i remember what they did to shell when shell took one man's patent and refused to pay, they even took shell to an international court

Many judgement of the court against federal government ended up without implementation.

Though , u took the right step by taking them to court at least u will shake the table small and international community will hear u.

Akwa Ibom should close those bank accounts and move to other banks! The banks involved should even be chased out of Akwa Ibom.

When banks connive with corrupt government agencies to commit crimes, they should be punished.

Udom Emmanuel must sit up and face reality. This is clearly the type of politics that Akpabio engages in. Udom must use "iron hand" to curtail the excesses and power that Godwill Akpabio continues to wield.

Going to church to preach every sunday will not help! Believe me god or some spirits won't hep you! Akpabio is very daring and must not be toyed with.

Udom must not allow Akpabio to breathe anyway in that state. Akpabio did this to all the PDP members who ran to APC. Udom should hunt and physically attack Akpabio anytime he's in the state. Nice precedent set yes by suing the EFCC but of what use is that in an administration that does not obey court orders?

If the court rules in their favour, how can it be enforced?

If not by pursuing n winning their case against crossriver n FG up to supreme Court!

Yeah agreed as u inferred, they gonna settle out of court in d yrs ahead. That's still a must step by any sensible govt.

Tell your UDOM to sit up and allowed his work to vote for him come 2019. How can someone work for 6years no promotion, no arrears, no impressed, no subvention and you expect the civil servants to vote for him. I don't want to mention pensioners.
