Inec under the electoral law has now power to cancel, reject or interfere in any electoral results already announced by the INEC appointed returning officer in any concluded election.

We saw it in T.A Orji Vs Ikpeazu, Uchendu Vs Sekibo etc..

I believed INEC announced the purported "Suspension" to calm frayed nerves pending the time they will issue the Certificate of Return to the announced winner.

Anyone who is not satisfied with the stipulated law of the electoral act, will have to explore the window of remedy through the Tribunal.

Consequently, the winner should continue his/her celebration as Nothing will upturn those results as announced by the Returning Officer except the court of Law.

Resident Electoral Commissioner (REC) for Anambra State, Mr. Edwin Nwatarali, has asserted that the Independent National Electoral Commission (INEC) has no powers to cancel any election result announced by INEC returning officer, saying those who felt aggrieved over the outcome of the national assembly election in Anambra State should pursue their matter at the election petition tribunal.

Nwatarali, who spoke during the handing over of certificate of return to the senators and nine House of Representatives -elect who were declared winners in the March 28, 2015 general elections, said he has been receiving incessant telephone calls since the announcement of the results, with some of those making the calls threatening him.

According to the Punch, the statement was made a few hours after the European Union (EU) Election Observation Mission (EOM) to Nigeria called for a probe of the “severe problems” that characterised the elections in the two states. Kayode Idowu, the chief press secretary to the INEC chairman, explained that once results had been announced by INEC, only election petition tribunals had the power to cancel and order fresh elections.

“The law does not allow us to cancel any result after it has been announced. Everyone knows this. “It is only the election petition tribunals that can order that or even cancelled the elections. Who is the returning officer and where did he declare the result?

In Abia state during the 2015 gov election, it was argued that inec does not have the right to cancel results announced and accepted (endorsed by parties to the election) at the polling units.
Rerun election was ordered IN those areas marred by violence in obingwa and osisioma LGAs.
The heading of the letter from inec is suspension not cancellation. Inec will resume the process when all allegations have been cleared.
