Not when the state went to kill the defendant few days before he would appear in court and he ran away. Couldn't the state have waited for him to appear in court and then pick him up from there ? The state didn't respect the bail so,dont blame Kanu for running for his dear life since the system does not protect him.

Kanu said he was going to be in Abuja and come back with Buhari's head and you're asking the state to protect him. Are you mentally okay?

1. "if the Nigeria Army acting under order from the FG had succeeded in killing him (Nnamdi Kanu), will the court of law still order his sureties to forfit such huge amount of money?"
2. "Since there is threat to life by the very people who took him to court, why then should his sureties be charged?"

The Federal High Court in Abuja has ordered the three persons, including Senator Eyinnaya Abaribe, who stood sureties for the leader of the Indigenous People of Biafra, Nnamdi Kanu, to within two months, pay the sum of N100m each into the court’s account for their inability to produce the missing Biafran activist in court.

Justice Binta Nyako gave the order on Wednesday in a ruling in which she amended the conditions of the bail she had in April 2017 granted Kanu.

Kanu is being prosecuted before the court on charges of treasonable felony.
His trial had been earlier separated from that of his co-accused following his disappearance after a military invasion of his home in Afara-Ukwu, Umuahia, in Abia State, on September 14, 2017
The three sureties who guaranteed his bail had been made to sign a bail bond of N100m each which was backed by their landed assets whose documents were deposited in court.
But with the amendment ordered by the court on Wednesday, they are now required to deposit cash of N100m in the bank account of the court.
Justice Nyako ruled that the three sureties had two months to pay the sum of N100m each into the court’s account.
The judge reiterated that the order directing the sureties to pay the money was an order of interim forfeiture.
She fixed March 28 for the hearing of the motions filed by the sureties to challenging the duties imposed on them to produce the IPOB leader.

pls any body who is legally knowledgeable should enlighten me,is it lawful that a party to a trial should use over whelming force on an accused on bail causing the accused to abscond n for the court to turn a blind eye to this n still hold the suretees liable without any legal action against the party that employed the force abinitio?.this kanu case appear to me as a brazen show of force n brutal punishment n suppression by the federal government against kanu n his suretees rather any element of the rule of law.

Kalu failed to appear in Court because the corrupt govt. illegally tried to murder him in his own home! He wasn't on the run before the army illegally invaded his home! The Court should hold tribalist Buhari responsible for this mess!!

Binta is talking arrant nonsense. The 100 million naira deposited by the sureties are still in the confers of Binta court. Which other money is she expecting from Abaribe and co? That order holds no water and we shall challenge it.

Personally, I think the judge is biased. The federal Government, through the military, went to Kanu's house to kill him. He escaped and left the country to save his life. Why is the judge holding the sureties responsible for what the government caused? If Kanu had stayed back to be killed, would Justice Binta Nyako have ordered that the Sureties bring his dead body to court for trial? Of course not

So why penalise the sureties over a situation the government caused? I think Abaribe and co should head to the appeal court because this is miscarriage of justice

Why no mention of jail.

They gave the c of o and deeds on their lands to the court to hold instead of depositing 100million cash which was the cost set by court for Kanu's release. The papers are still with court. To get their deeds to the land back they must now make good on the 100million cash initially set. They have two months to find it. Thats total of 300million coming to court. As each one pays his 100million his land deeds will return to him. Anyone not able to make the deposit will loose that land deeds; the court becomes owner of the land.

They can be jailed if they prove difficult, in addition to settling the cost, but more likely they will not if they respect the court and submit to its judgement.
