The refugee board is not smiling. You are a Nigerian and you crossed from the US, it would take a miracle to be granted immigration status. Go through the following cases below and see.

She'll be asked why didn't she claim the refugee status in the US. Those who are claiming homosexuality, Genital mutilation and Boko haram are also being denied.

Lol, I read through the cases and most of their claims were bogus and they did not provide proper evidence . When one wants to claim asylum in a country, one has to bring proper evidence.

Its hard to provide proper evidence when you went to the US on a tourist visa. You already have a record and at your visa interview, you gave the visa officer the impression that you would return back to the country.
At her asylum hearing, the first question she would be asked is why didn't she apply for asylum in the US. If your life was so threatened that you dread returning back to your country, you would not wait 4 years before filing asylum.

Shalom oga AZeD1, but those are just 3 cases out of .... hundreds thousands . In my opinion, it is insufficient to come to the conclusion that a Nigerian who crosses the US Canada border will be rejected by the refugee board. Adding to that each person's case is treated on its own merit.

How is computer programming by the way?

I just shared those 3 for now. If you check the site, you would see more. As of now, the current report is 7 out of 10 asylum requests from Nigeria are rejected. Also going through the rejected cases, you would see that the asylum board is asking why didn't you relocate in Nigeria (Internal Flight Alternative).

Also remember 2019 is an election year and immigration is a very touchy subject.

Programming is fine......

Rejection rates for Nigerians who crossed over to Canada is 70.7%

Just not that case but the only cases did not provide credible evidence. Unfortunately asylum cases are not strong to prove for Nigerians. The Canadians government does not believe that Nigeria in the whole sense is unsafe to be grant asylum from the cases being read and the op would of this thread would not qualify for asylum. Most of the approved asylum seekers that I know are from documented war torn countries.

Nairaland is a sobbing partner for illegal aliens now? When she decided to stay back did she contact nairaland for advice?

Problem she created by illegal staying in the country beyond the legally approved period?

Lol, the op should be careful with immigration lawyers. They are costly and some of them are useless.

Huh, I'm surprised it's not higher than that.

In Canada abused women are considered women at risk and would make strong asylum case. OP doesn't have to be from a war torn country if she is fearing the father of her kids whom she has been reluctant to talk about.

Some of the even make the case more difficult in order to make more money. Like stated before, the only option for the op is either the government pardons her by an immigration reform( which the chances are very slim at this point) gets married or leave the country.

Yes but that does not appear to be the case for the op case, she has stated the children father is back home but he very much involved in their lives. In order to claim you have to provide strong evidence that you are abused and no where in your home country is safe for you.

Apparently, that is the easiest made up and abused asylum claims most women from those foreign countries are now using to get their cases at least heard in Canada and the US.

Huh, don't be surprised if that ends up changing.

Most lawyers trying to get her to use the asylum claim will offer her the spouse abused claim.

Like stated, earlier, you have to provide SOLID PROOF, in the op case she came here on a visiting visa visa and overstayed for 4 years. her chances are slim.

Thanks guys. I think I'll just try and save up as much as I can for now. If within those periods I'm able to do my papers, fine and good. If not, I'll just move back to Nigeria.

Dear OP,

You couldn’t have said any better. Save up as much as you can, consider good schooling options and a sustainable comfortable lifestyle for your children and yourself if you do choose to come home. Be warned! It will not be easy with or without money, so the more money you have, the better your chances of not slipping into some form of depression every now and then.
Whatever you decide to do, make sure you are committed to stand by it through good and bad times. You can relive your relocation dreams through your children and even your improved skills in the nearest future.
Start living like you have no other place to go to, that might help you find a way to fix your status and start saving and planning like you have no choice but to come back home, that will help your quality of life if you do decide to return.
Think where you want to be 10 years from now and the kind of life you would want to live with the information at hand currently, and make a cry informed, not purely sentimental decision.
May God show you the way forward.
I wish you the best.

I know of 2 cases personally (women) who got their asylum approved in Canada, one is Nigerian and she claimed domestic violence with a bogus letter from a Doctor in lagos who owns a hospital, she had an accident prior to her arrival to Canada in Nigeria, she took pictures of the injury on one side of her body coupled with the detailed letter from the Doctor / hospital in lagos that the injury was as a result of abuse / beatings from the husband, and fiam, her claim was accepted.

The second lady is from Burundi, she claimed to be a lesbian fleeing Burundi due to persecution, she arrived Canada, and there was a gay parade in downtown Toronto, she joined the parade, took several pictures with the gay community around Church Street l think, she finally got a letter from the gay community, went for her hearing and she was approved, this happened before the current influx of US visit visa holders to Canadian borders, as I post both women are Canadian citizens, I know the two of them personally but this are just two isolated cases, other women tried the same stories and they refused them grin

Oh wow!....But why am I not surprised though?

We are talking about Canada. Believe it or not they are in desperate need to have more people add on to their very low population compared to the very big space as a country they have.

So yes all those bogus asylum claim cases might take the Canadian government very little to over scrutinize.

But Aduro / asylum levels for Nigerians either arriving Canada by flight or coming from the US don cast, refugee board don taya with fake Oluwole stories from Nigeria.

if you are not from Syria, Afghanistan, Yemen, South Sudan and Libya, your chances of getting your asylum approved by the various refugee boards both in North America and Western Europe is very slim, even those from the war ravaged countries l mentioned above are seriously been screened in Europe now because of infiltration of former ISIS terrorist using the same route to seek asylum, so for someone from Nigeria / Ghana or West Africa to ask for asylum in 2019 is like a camel passing through the eyes of a needle . grin

Dear OP, I was deeply moved by your story.
To me the greatest thing of all is Peace of mind and I don’t think you have it over there, life of a fugitive.
What is the point of living like that, a life full of fear and uncertainty especially for the kids. If you were living alone I’d say stay and take a chance over there.
You are still very young I don’t want you running around in circles for years and nothing to show for it. Before you know it you’re 40 and still in this mess.
Nigeria is bad but not as bad as people say. I’m 26 finished school a few years ago and now I’m doing relatively well. My family wasn’t rich but little by little we got by and now I’m here.
I think you should come back but first save at least 5million. When you get back buy a land around Lagos for like 2-2.5M, the plan is to keep it for about 10years. Use say 1-1.5M to open a superstore. This should be able to make you around 80K a month give or take. With this you can sustain yourself and your kids since you won’t be paying rent. As time goes on you’ll be able to make extra money doing other things.
In 10years or more that land would be worth at least 10M and you’ll be able to send your child to school abroad preferably Canada for a more better chance to make it.
Here you have all the support and love from family. Living in America as an illegal alien with kids is just pretty messed up to me.

He only gave the suggestion without having experience.
5m is not a feasible amount to fall back on, Land of that amount is possible but 1.5m can never setup a SUPERSTORE.
I am not in the ops shoes for me to know how she actually feels. But with the way things are, I would rather take my chances by staying there unless I have something to fall back on in Nigeria.
But for someone who doesn't have a backup in Nigeria will rather work to save money. I don't blame Nigerians that are desperate to leave the shores. Imagine getting under the table jobs yet still able to save $3k but that same job in Nigeria will have you living from hand to mouth.
