His career is finished. If he had honourably resigned he would be entitled to gratuities etc. But for now nothing for him and he will be dismissed base in criminal case

PoliticsNGR has gotten more details on the rejection of a motion filed by the suspended Chief Justice of Nigeria, Walter Onnoghen by the court of Appeal.

It was gathered that the Court of Appeal in Abuja rejected the request of Onnoghen to stay proceedings in the charge pending against him before the Code of Conduct Tribunal (CCT).

A three-man panel, led by Justice Abdul Aboki, in a ruling, dismissed the application Onnoghen filed to that effect.

The court said, in view of the provision of Section 306 of the Administration of Criminal Justice Act (ACJA), it lacked the power to stay proceedings in criminal cases.

No exparte order can order the president to suspend the CJN.No court can make such orders.Not even the supreme court.

It means the criminal justice system in Nigeria should be upgraded to reflect her British common law heritage. Court of Appeal should have a division to hear criminal cases. Most of the criminal case -laws cited by defence barristers in the UK were rulings of the court of appeal. Establishing such a division is good for law students even as it would enrich Nigeria's legal history.

Agreed we know what happened to saraki case. Thee former CJN would have allowed the process to go on instead of runing from pillar to post in other to suppress the process. If he had allowed it, He may win the case or the other way round instead of creating tension everywhere. The question everyone should be asking is why did the Former CJN not declare his full assets. He knows the implications because he has ruled on many cases concerning these issue.

Leave that talk! If Buhari had wanted for this ruling, Onnoghen would have still appealed to the Supreme Cour, then we would be back to square one.

For Onnoghen case to have been referred to as a criminal case by the Court of Appeal confirms my stand on this issue and it reflects the personality of those people and the political clout supporting him.

Onnoghen is just embarrassing himself the more. He should have resigned quietly.
