Op, to counter your article and to those who wish to learn, where a judgment is been delivered and there are 3 judges like in this Osun case, where two judges are of the same view and one is against it, the majority carries the vote so the chairman view doesn't change anything.

Even if it's at the Supreme Court, and the Chief Justice is dissenting and two others are agreeing, those agreeing carries the day.


That's why some uninformed people are thinking that for the so called Acting CJN Buhari sworn in illegally will help Buhari during judgment, if other judges dissent from declaring Buhari winner and the So called Acting CJN upheld the judgment during Atiku vs Buhari appeal, nothing the Acting CJN can do, majority carries the day. Mind you I'm neither pro APC or Pro PDP in national level.

The chairman of the Osun State Elections Petitions Tribunal in Abuja has delivered a dissenting judgement in the Osun State governorship election petition.

Justice Muhammed Ibrahim Sirajo on Friday dismissed the petition by the Peoples Democratic Party (PDP) and its governorship candidate, Ademola Adeleke, which alleged that there was election non-compliance with the Electoral Act in the election.

Justice Sirajo ruled that the petitioners failed to prove the claims at the tribunal.

He further ruled that where it is established that there is non compliance, the tribunal does not have “the powers to subtract the votes of the non compliance and declare a candidate winner.”


He added that under Section 140(3) of the Electoral Act, where substantial non compliance is proved, the tribunal can only order a supplementary or fresh election.


The chairman however adviced INEC to only comply with the majority decisions concurrently delivered by Justices Peter Chudi Obiorah and Adegboye Ayinla Gbolagunte.

The main judgment of the panel had invalidated the rerun election of September 27, 2018 which returned Governor Gboyega Oyetola as winner and withdrew the certificate of return issued to him by INEC.

One is saying supplementary is unconstitutional while another one is saying the only constitutional option for the tribunal is supplementary.

The Nigerian judiciary is fuxced up.

. This iis a two one judgement. The appeal will now decide if the tribunal erred in declaring Adeleke winner and if it erred in saying Oyetola is the winner. I will not congratulate either of them until the judgement is given by Supreme court in July ....Appeal and supreme court can have a different opinion on the matter...Time will tell on Osun election crisis

Did you read the article or you were just eager to comment. The OP did rightly pointed out that THE CHAIRMAN OF THE TRIBUNAL disagreed with the judgement of the other two judges. It means it is a dissenting judgement,and the judgement of the other judges will take precedence...

Did you read the article or you were just eager to comment. The OP did rightly pointed out that THE CHAIRMAN OF THE TRIBUNAL disagreed with the judgement of the other two judges. It means it is a dissenting judgement,and the judgement of the other judges will take precedence...

Was thinking the same thing! Had there been two northern muslim judges delivering judgment, i can bet it would have gone the other way in favour of APC! Most of them are closet APC/Buhari/Islam apologists no matter how they may try to throw you off the scent! This is why Buhari illegally suspended Onnoghen, and replaced him with his ‘brother’!

The way laws are interpreted in this country, you will agree with me that either the law schools curriculum is faulty or the custodian of the laws have suddenly gone in direct opposition to the provisions of the law of the country.

It's Clear, and this has always been the case.. When Oshiomole was declared winner in the Court then it was only 2 Justices that supported his case so also for Adeleke..Oyetola will be out latest Wednesday next week and will Appeal as an Ex-Governor.....Atiku victory on the Road.. Onnoghen Reinstatement soonest..

The election is no longer inconclusive because the "cancelled" votes didn't follow the legal procedure only presiding officers can cancel votes not Returning officers which was the case in osun

Inec couldn't prove that the doctored forms were just "honest" mistake

I still don't know how Apc will scale through the tribunal was too meticulous
