just as the tribunal has declared Adeleke the winner of the osun guber poll, I'm just wondering when is the constitutional provision for him to be sworn into office.
could it be now or after the appeal Court's verdict?
pls pardon my ignorance!

after the tribunal, its appeal court ruling cos I'm sure the apc would appeal the ruling and pursue the case to any extent, even though governorship electoral cases end at the appeal court...however, with the facts adeleke has on ground, it's unlikely that the judgement would be upturned eventually

The Supreme Court has a different way of looking at things. APC won the tribunal, and appeal court in 2015. Only for the Supreme Court to declare PDP

PDP can never lose an election at the Supreme Court.

In the eye of the law, if APC and Oyetayo are yet to file an appeal and a STAY OF EXECUTION of the ruling of the Tribunal at the Appeal Court, Osun State is currently on LACUNA.

Saturday is not a working day so IF they've not done that yet, then Osun State have no Governor till Monday

There is a time frame to appeal. So invariably in the same eyes of the law you quoted, he remains the Gov until the time of appeal lapses

dont waste your money grin. What gave aregbe, oshiomohle, mimiko , etc victory at the tribunal in their time weren't as clear as evidence adeleke is having. Just be patient, ok? Those judges, from the tribunal to the appeal court are learned enough to deliver judgement without bias. Unfortunately, Buhari wont take sides with corrupt politicians especially this second term he knows he's got nothing to lose.

Pls state the loopholes.
One,cancelling results of polling units without ordering a rerun as prescribed by section 140 of the electoral act.two, declaring the rerun in 7 polling units illegal since returning officers do not have powers to cancel pu elections.they tribunal didnt look at the reason why those polling unit results were canceled to see whether they can cancel or upheld it

Look at the reason why it was cancelled even when he had no power to do that?

I believe Oyetola is filling for an appeal, let's wait till then.

How can a junior officer possess more power than a senior officer? Anyway, lets assume that the returning officer had no powers to cancel the units but on the others, the tribunal has the powers.why not look at the 7 polling units and establish whether votes there was lawful or did not comply with the electoral acts ? Why just leave those units hanging? Too many comas
