Ademola Adeleke: Flawed Bwari Judgement Won't Stand


We receive with shock and bewilderment the judgement of a Bwari High Court on the propriety of the statement of results of Senator Ademola Adeleke as a contestant for the governorship of Osun state.The judgement delivered today subverted justice by ignoring four critical evidence to rule against validated facts and submissions.

While we are set to appeal the judgement ,we also find it compelling to put the records straight by listing out the fatal flaws in the ruling and why it cannot stand before a superior court.

It would be recalled first of all that the matter in question has been addressed by two High Courts ruling ,affirming that in the face of the constitution,Senator
Ademola Adeleke is qualified to run for the governorship. The two rulings delivered in September 2018 held that Senator Adeleke satisfied requirement of the law to contest for office.It is trite in law that once a court of coordinate jurisdiction has ruled on a matter ,court of similar jurisdiction cannot entertain it.Shockingly,the Bwari judge breached this precept to subvert justice.

Secondly ,we want to note that the judge erred in law by failing to take note of the expiration of 180 days for ruling on pre-election matters.Even when a December 2018 judgement with respect to the issue was presented, the judge ignored it. We note that the judge violated the law by adjudicating over a matter whose filing and hearing period has expired.

Thirdly,the West African Examination Council was also summoned by the court at the instance of the plaintiff to present evidence of facts.The council produced the listing of all students who sat for the May/June examination in 1981 alongside the Senator.The Council produced certified true copies of school results.

The Council produced evidence which proved that Senator Ademola Adeleke was indeed educated up to secondary school level as stipulated by law and therefore qualified to run for the governorship, the judge still went ahead to rule otherwise.The WAEC at no point denounced the secondary school qualification of Senator Adeleke.The only statutory body empowered by law to determine authenticity of a secondary results is the West African Examination Council.The Council not only witnessed in support of Senator Adeleke but also presented certified true copies of his school results.What other evidence the judge needs to rule in favour of the Senator is not clear.

Fourthly, the plaintif shocked by WAEC testimony, again filed request that the court compelled the school principal to appear in court to produce evidence of facts as well as to confirm the authenticity of the statement of results. The principal appeared and confirmed that the statement was a product of the school and that any error on the statement was that of the school ,not that of Senator Adeleke.The school did not at any point disowned the statement of results .The school owned up to the error which was not about forgery but alleged false information.

From the foregoing ,we affirm that today's judgement of the Bwari court is a travesty of justice, a purchased ruling designed to negatively affect the outcome of Osun governorship legal tussle.We declare unequivocally that the ruling being so glaringly against tested facts and the law cannot stand.It is also clear that the ruling cannot in anyway stop the reality that Ademola Adeleke fulfilled constitutional requirements to stand for the governorship as confirmed by the WAEC,the school principal and previous judgements on the matter.

We appeal to our numerous supporters and good people of Osun state to remain calm
This is another failed bid in the efforts of detractors to stop the realisation of Peoples mandate.We are marching ahead as before the law,our candidate, Ademola Adeleke is qualified to seek the governorship and before people and God ,he is the governor elect of Osun state.

If he's not careful, they would collect his Senate seat from him. On fact, if he dare loses this forgery case at the Supreme Court, a new suit seeking to declare kick him out would be filed.

Osun APC deserves a condolences messages, they are making every efforts to purchase a judgement against elected and declared by tribunal court as a lawful governor of Osun State, Senator Nurudeen Ademola Adeleke (Imole).

Before September 22 governorship election in Osun State, there was a subsisting judgement delivered by Justice Oladimeji @ Osogbo High Court which ruled that Senator Ademola Adeleke is qualified to contest the election, Wahab Raheem and Adam Abeeb who filed the case failed to appeal the judgement before election, the case was struck out completely.

Immediately after the tribunal judgment, Osun APC through their pseudo agents Wahab Raheem and Adam Abeeb took the same case that have been struck out in Osogbo high court to Abuja high court and successfully purchased a judgement to stop the moving train � of Senator Nurudeen Ademola Adeleke.

Did Abuja High Court have jurisdiction to hear this case that have been struck out in Osogbo high court?

In their thinking, they want to achieve 3 things "EMBARRASSMENT" " CONFUSION" and DISTRACTIONS.........., It will be difficult for any agents of darkness to achieve this against Senator Nurudeen Ademola Adeleke.

Justice Musa said while the court’s findings showed that Adeleke entered secondary school in 1976, there was no record to show that he actually graduated as his name was no longer seen in the school’s register from 1980.

He further stated that the result Adeleke attached to his form CF001 which he submitted to the Independent National Electoral Commission (INEC) was fake, as it was found to be different from the one presented to the court by the principal of Ede Muslim High School, Ede, Osun State.

The judgment is purely a script that was acted out... It will not stand the true test of justice in any court of law!!!
The judge ignored many evidence that were tendered before it as exhibits that Senator Ademola Adeleke does not know anything about the forgery matter... And WAEC as the only authorised body by law to issue a WASCE Certificate has come out to show to the world that Ademola Adeleke has a result and the copy of the authentic result was issued to the public(alongside a press release)... And WAEC also came to that same court to testify too.
Furthermore, last year the court of appeal upheld the eligibility of Senator Ademola Adeleke to contest the gubernatorial election of Osun state in 2018. Again, the just concluded Election Petition Tribunal Court of Osun gubernatorial election-2018 also upheld the eligibility of Senator Ademola Adeleke to contest the gubernatorial election too.
Even by virtue of the provisions of section 177(a-d) of the Constitution of Federal Republic of Nigeria(with particular reference to subsection -'d' of the above reference), Senator Ademola Adeleke is evidently qualified.
This newly conjured judgment is an absolute miscarriage of justice with a deliberate attempt to mislead the public, discredit the eligibility of Senator Ademola Adeleke and concoct a false mandate on Gboyega Oyetola.
We have done the needful by heading straight to Court of Appeal and also ask for a stay of judgment in this regard too.
Tell our people to calm down because there is no iota of reason to panic or lose any sleep over this matter. WE WILL WIN AGAIN AT THE COURT OF APPEAL... WE ARE BRINGING THE MANDATE HOME SOON!!!

Justice Musa, had in a ruling delivered on September 11 directed that WAEC should depose an affidavit, to either deny or confirm that Adeleke sat for the Exams the Council conducted at Ede Muslim High School in Ede, Osun State, in 1981.

It equally said the examination body should file the ledger containing results of Ademola and his mates with whom he sat for the examinations, as well the verifying affidavit, within five days of being served with the enrolled order dated September 11.

WAEC however in the sworn affidavit confirmed that, Adeleke with center number 19645 and candidate number 149 indeed sat for the Senior Secondary School Certificate Examination in May/June 1981 conducted by the council at Ede Muslim School situate at P.O. Box 6 Yidi Road, Ede, State of Osun.

Accompanying the affidavit was a ledger containing the result of all candidates (001-221) who sat for the Senior Secondary School Certificate Examination in the said school.

The certified true copy of the ledger which is marked as exhibit WA1, however showed that Senator Adeleke, sat for only English Language in the examination.

To be frank, the man is highly a shameless man, to provide ORDINARY O level result as a governorship shouldn't suppose to be any issue at all especially someone from his family that has a Private university. I think to make Nigeria a better one MSc or Phd or equivalent should be the MINIMUM requirements for governors upward ,O level for councillors.

This is the constitutional requirements for governorship in Nigeria;

To be elected as Governor of a State in Nigeria, one must fulfill the following requirements:
He must be a citizen of Nigeria by birth;
He must have attained the age of thirty-five years;
He must be a member of a political party and that political party must have sponsored him; and
He must also be educated to at least the School certificate level or its equivalent.
A simple solution is for Senator Adeleke to present his WAEC certificate

In an affidavit deposed to by the Deputy Registrar/Head of School Examination Department WAEC, Henry Sunday Adewunmi Osindeinde confirmed that Adeleke sat for the May/June 1981 at Ede Muslim High School, Yidi Road, Ede...

Osideinde stated that the examination centre number was 19645 while Adeleke’s number as a candidate in the centre was 149....

WAEC attached a copy of the results of all 221 candidates that sat for the May/June 1981 in the centre at Ede Muslim High School...

Osindeinde said in the affidavit that: “By virtue of my position as Deputy Registrar/Head of School Examination Department, I have read the enrolled order of this court (specifically orders iv, v and vi) dated 11th September 2018 directing and compelling the WAEC to depose to an affidavit confirming or denying the said orders contained in the said enrolled order and referred to in this paragraph And I wish to state as follows:

“The said candidate named in this suit known as Adeleke Ademola, with Centre Number 19645 and Candidate Number 149, indeed sat for the Senior Secondary School Certificate Examination in May/June 1981 conducted by the council at Ede Muslim High School situate at P. O. Box 6 Yidi Road, Ede, State of Osun.

“The copy of the result listing referred to by the court order as the ledger containing the results of all the candidates (001 – 221) who sat for the Senior Secondary School Certificate Examination in the said school is hereby certified, attached and marked: Exhibit WA1.."

NOBODY CAN STOP THE WORK OF GOD, NOT EVEN TINUBU OR BUHARI

Either good or bad judgment was delivered by Abuja high court yesterday and Adeleke will definitely appeal the judgment while election petition appeal is ongoing.

I am using this medium to call on good people of Osun state and esteem supporters of PDP and Senator Nurudeen Ademola Adeleke not to hesitate any form of fear as the judgment gave yesterday by Abuja high court as no effect on struggle to reclaim our stolen mandate from Ajele's and APC.

● Osun election petition Tribunal also cleared him on same issue

APC is only trying to distract us from the existing struggle, since they aware of their failure at appeal and supreme court. It is clear to entire world that Senator Ademola Adeleke won Osun governorship election and he possess every prerequisite to contest as governor of the state.

What happened yesterday is a clear indication that Oyetola and APC is aware they will fail at the two remaining election courts, so they are looking for more ways to blackmail the Judiciary after their failed protest.

No amount of intimidation or distraction can stop us from reclaiming our stolen mandate, let us remain focus and be prayerful.
