That APC has been disqualified by the Supreme court, and subsequently voided their votes, is no longer a news.

However, the Supreme court in passing their Judgement was being careful and vigilant not to create another constitutional crisis, hence the caveat " the second highest scoring party which met the Constitutional requirements should be sworn in as elected.

Now, which party came second?- PDP

Did the PDP meet the constructional requirements, for instance in the Governorship election?

Then, let's see the scores of PDP and APC as regards the Zamfara Governorship Election:

The apex court ordered that runner-up candidate be sworn in if he fulfils the constitutional requirement of getting one quarter of the total votes cast in at least 2/3 of LGs of d state.

Here is the analysis:

Total votes cast: 810,782
APC: 534,541 votes
PDP: 189,452 votes

Now if you remove the Voided Votes which now include that of the APC...You are now left with 189,452 votes of the PDP and about 10,000 combined votes of the "also ran" parties which will total about 200,000 votes.

From the above analysis, it is very clear that void votes are way higher than valid votes, which a winner CANNOT be Validly Returned.

Only Option before the INEC: order a rerun of the entire election, which must exclude APC ( Since the window for primaries had since closed).

Option before APC: Adopt one of the "also ran parties" put the picture of Buhari on the banners, and let their candidates be the candidates of the APC.

End!..

The problem with Today's youth is that we don't read, but only rely on gossip.

The Supreme court clearly stated the "2nd Position" must meet the Constitutional requirements.

The question is : Did the "second" meet the Constitutional requirements to be returned as duly elected?

Do you think the Justices are foolish in putting the Caveat?

Wait o, what is the original voided votes? You can't add ApC votes to the number of voided votes and say there will be a re run.
Also the supreme court said the votes given to APC are wasted votes, which I think is different from voided votes.

https://en.m.wikipedia.org/wiki/Wasted_vote

https://en.m.wikipedia.org/wiki/Spoilt_vote

Wiki has defined it for you. So I was right in my opinion. Voided votes are votes rejected and wasted votes are votes that have been needlessly added to that of a candidate.

So the constitutional requirement will be decided based on all votes casted for the other parties after subtracting what APC got. If PDP had 180+ and the others had 10,000 combined. Then they obviously met the two-third criteria. Unless the number of voided votes on the day of election is more than the difference between pdp and the party which came third.

Total Vote cast is 810, 782.

Remove APC voided votes, which is about 534, 000, of even of you dash the remaining to the PDP, it CANNOT meet the Constitutional requirements, because the voided votes are already higher than the Valid Votes..

Do you get it now?

These votes stand as though they were never cast because APC had no candidates in the eyes of the law. Those trashed votes will not now become numbers to reckon with for any reason. By this judgement they do not exist, they are wasted and not voided by reason of mutilation or disenfranchisement.
Therefore the contitutional spread will now be based in existing valid votes to the exclusion of all others.

Going by your analogy and the definition of wasted votes and voided votes, the total votes cast becomes 276,782 votes.

The judgement is very clear.APC votes are wasted votes which is different from voided votes. The total valid votes is less than 200,000 and PDP has 186,542 so the party has met the requirement. Anyway let us wait for inec pronouncement on Monday.

if I may get you well, rerun will only take place as per 200,000 votes in which PDP only need 5600 to win the election.PDP=189000+,adopted party=0.000,vote to be contested=200000.anyway Kano treatment is possible.lol!we are talking about voided votes and not cancelled votes.

APC votes are all invalidated. Unless on the grounds of the winning margin between PDP and the second runner up being less than the invalid votes.
