P.M.EXPRESS reports that Elijah was caught, forced to remove his dick from the victim’s private part and thereafter handed over to the Police by the parents of the victim.

The incident happened at Sholanke Street in Ajao Estate, Lagos, where he resides with the victim’s parents.

It was gathered that Elijah sneaked into the victim’s apartment at about 12 midnight while she was sleeping and engaged her in sex romp without the victim raising any alarm.

However, in the middle of the act, Elijah was forced to remove her dick from the victim’s private part after her mother, who had suspected their movement during the day and monitored them, caught him. He later handed over to the Police.

During interrogation at the Police Station, Elijah denied raping the victim and told the Police that both of them had consented to engage in the romp. But the parents of the victim insisted that their girl was still under aged and that it was a sexual assault on the victim.

The police found the suspect, Elijah, culpable and charged him before the Ogba Magistrates court for sexual assault which is statutory rape.
He pleaded not guilty.

This is not rape ,they both agreed to it,the mother has seen their movement in the day time,,why can't the lady shount if it is rape? The mother only went there to obstruct their session

That section you quoted and the interpretation you gave are completely out of context. That section said nothing about 14 years even section 362 that mentioned sixteen years only did that with reference to the crime of abduction, my point is that a minor cannot give consent and a minor is someone under 18, i would like to see that part of Nigerian law (passed by senate and assented by the president) that gives a different definition of the age of a minor.

yes I agree but I also believe that with the present nature of the world and the country,a 15 year old girl,knows exactly what she is doing,except the parents of that girl are so irresponsible that they cannot educate the girl on some very sensitive matters.anyway,I still stand on the fact that they are both teenagers and so are both kids.if you say the boy is an adult,then when your child is 19,stop taking care of him.stop feeding him,stop paying his undergraduate fees,tell him to leave your house and find his own as an adult should.oh yes,tell him to get married.

Unfortunately the law court does not care about the nature of the world but what the law says. Will we now say that because killing is now common happening in Nigeria we should set free someone to committed murder?
