Have you ever seen a judge presiding with his/her senior as a panel member? no Tanko Muhammad was presiding on the Imo judgement. Kekere-Ekun only read the lead judgement. They are two different things. It's hierarchy,most senior always presides. In this case, Odili was presiding but Ejembi Eko read the lead judgement. (would you say Eko was presiding) NO? |

APC's greatest undoing though is the party's failure to challenge the constitution of the panel knowing full well justice odili's affinity to PDP |

Caseless:Odili only presided on a panel.... Was the panel right go give the judgement? Yes. I wouldn't blame those who are attacking Odili of making the decision. They are 100% APC members. Uwani Ab'aji read the SC lead judgement that gave buhari victory over Atiku. Kekere-Ekun read for the loss of Ihedioha in Imo State. (CJN Tanko presided over both panels, and the PDP members attacked him) So, for partisan individuals....that's fine! |

Caseless:A court of competent jurisdiction has vacated those sections of the Electoral Act. Unfortunately, one of those attacking Odili posted it on Nairaland. Read this: http://www.vanguardngr.com/2011/07/court-rejects-sections-of-2010-electoral-act/ A Federal High Court in Abuja, yesterday, ordered election petition tribunals sitting across the federation to ignore provisions of section 140(2) and 141 of Electoral Act 2010, saying it was vague, unconstitutional and a deliberate attempt by the legislative arm of government to usurp powers of the judiciary. Nullifying the two sections, the high court equally gave election tribunals nod to declare a candidate winner of any disputed election process brought before it, stressing that provisions of the aforementioned sections were inconsistent with both section 239 and 285 of the 1999 Constitution as amended.
