No immigrant visas will be issued to applicants from Nigeria after 21st of Feb except the CO determines that such an applicant qualifies for a waiver, then such person would go through the waiver process

Again I am asking the question: how do you know this? Someone earlier told me it was a foolish question but with the varieties of opinions on this forum I don’t know what to believe anymore except that we are all just guessing. My second question is will interviews still go on ? And then again is the moral issue of a retroactive decree which punishes people who have passed the “documentarily qualified “ stage especially family visa applicants. Again if you are refused because of Presidential proclamation and you decline waiver, when the ban is lifted do you begin the entire process all over again? These are things you ought also to be telling us and not just the negative . Please also advise on practical way forward

2. If it is accepted by USCIS and NVC (if all documents are correct), you get NOA1 and NOA2, the NVC number and follow the process as usual until the Interview.
3. You can be approved in the Interview but NO visa will be issued as there will be NO Priority Date for you because of the Ban.
4. Your file goes to Administrative Processing until the Ban is lifted or you have a very special situation and your waiver is approved.
5. When the Ban is lifted, all applicants are in line to get the interview and medicals, police report again. It will be a long line (many people waiting) and the process will be longer even with the ban lifted.
6. Better to apply now or after the ban is lifted? With Immigration it's better to start the process as soon as you can. Sooner you start, sooner your approval will come, it will be a very long waiting time, line of people.
7. If your documents and payments are accepted, you will not to apply again unless your petition is denied. Just waiting in line until the Ban is lifted.

I have interview date February 27 , I am parent of a citizen. All documents submitted and accepted and also I have done medicals with Q-Life. Obviously from ongoing it will be denied. I will not also apply for waiver since I am not so desperate .So what happens? Confusion.

My candid advice to everyone affected by the ban is :
Don't loose sleep over this ban thing.*Get busy and concentrate on something else* the whole thing won't go beyond this year I believe especially if you have scaled through the documentation stage....
You will only need to do Police and medicals again.

Nigeria: Nigeria does not comply with the established identity-management and information-sharing criteria assessed by the performance metrics.

Suspension of entry for Immigrants, except as Special Immigrants whose eligibility is based on having provided assistance to the U.S. Government.
"Special immigrants"
My question is since we don't have special immigrants that provides assistance to US government as in Iraq or other country; does this exception also applied to other 'Special' categories like Eb4 Special immigrants Religious Minister? Thanks

This makes a whole lot of sense.

Ones you are Documentarily Qualified, You still go through throw all the process down to Interview... after which you are either issued a VISA or Placed on Administrative Processing (i.e.- Visa on HOLD) pending when the BAN is lifted.

Good afternoon people, I didn't see any answers online addressing the effect of the ban on a Nigerian that's a legal resident of another country and will be applying from that country. Any ideas on how that will be handled?

Nigerian is a Nigerian and if you apply with a Nigerian passport, you are in the ban situation. If you apply with your adopted country passport, even there you will be asked to present the police report from places where did you live and if it includes Nigeria, it may got you in a ban waiting line too.

Ok. the reason I ask is because the reason for the ban allegedly has to do with Nigeria sharing certain information so if a person is resident in a country without those issues it could make a difference in the consideration for a waiver. Although one can't predict these people...

I am just seeing (3) from your reply. IR5 immigrant visas do not have Priority Date. They are unlimited.

Diversity Visa appointment dates cannot be rescheduled. If you have an interview date scheduled, you must attend your scheduled interview. For the umpteenth time the US Consulate in Lagos has NO POWER OF DISCRETION over family immigration, and not even to summarily deny you your immigration visa . It is all handled by USCIS. Even USCIS decides when you are ready to be interviewed and they only ask the Consulate for available dates. The only job of the Consulate is to verify your submitted documents and hand your travel package over to you. Unlike work based on diversity immigration applications the waiver process may not be an available option for family immigration and really does not seem to make any sense for family immigration since you are not even the original petitioner .This is the advice I received from a US Immigration lawyer.

A US lawyer advises: America is not ruled by decrees. The laws of the land do not permit retroactive application of new directives. If the ban eventually holds it can only affect those whose documentation are still in the loop and not those already qualified and asked to proceed to interview. Otherwise watch out for legal fireworks within next week. sad

This cannot be from a qualified immigration lawyer based in the US; except he is not in touch with the events surrounding the ban. This ban has already gone to court and has been settled. It was contested by immigration lawyers, the Democrats and nationals of the countries which were placed on the first travel ban. After 1year in court, the supreme court ruled in favor of the Trump administration and asserted that the presidential proclamation stands ahead of any other law since the ban is hinged on the security of life and properties of the American people. I have realized that in a bid to sound positive or seek solace in the face of hope, many people have gone ahead to disseminate falsehood about this ban. ANYONE WHOSE INTERVIEW DATE IS AFTER 21st FEBRUARY IS SUBJECT TO THIS BAN; both immediate and "non-immediate" relatives. Also, I have noticed talks about public charge rule which are being misrepresented here as well. Public charge rule has nothing to do with the immigration ban and is a totally different thing. It simply deals with limitations on the immigration rights of individuals who are dependent on government benefits. By that, the government wants only those who can support themselves to seek green cards and/or naturalization.
I am compelled to make this comment because some of us benefitted from this thread during the processing of our immigrant petitions and would want the right information to be deposited here for consumption. The idea that immediate relative or applications filed before the ban or approved before the ban are exempted completely negates the information given by the DHS and which the DHS has re-echoed severally.
