you need a lawyer since the tenant has refused to corporate with you. And he needs not to be given quite notice that's if it's true that he didn't pay since 2018, all he needs is 7 days notice of owners intention to recover possession. If he fails to pack out after the 7 days then you have to proceed to court. So it's better you approach a lawyer.

I knew the law cannot cheat anyone even though am not a lawyer.

A tenant owing over 6 months rent does not deserve months of notice any longer.

And he has mandated me to make sure everything was upto date, whenever he calls and I give him updates he told me to take necessary measures already...

I have spoken with the tenants in question a couple of time, I also try to make a deal with him about clearing his 2018 rent, we not even talking 2019, but 18...

For the past 2 weeks he is evasive and yesterday he broke the camel's back by referring me to talk to his wife blah blah, I just felt he thought I could do nothing and eldest bro will just issue non- binding threats as usual....


I have scourge online and I have written a "quit notice" letter, however I do not know the steps to take, do I serve him in person? Or through a lawyer(I don't have one) or I can't even serve him at all, but I want something done today or nothing will be done at all... He is not the only tenants owing 2018, and I feel I will send a clear messages to other tenants owing with my actions or steps taken....

I need some useful help, the care of the house is entrusted to me, not by choice tho, but cuz I currently reside here...
brother serve him d quick notice yhur self...if he doesn't comply and also not willing to pay...just don't bother yhur self to ask again...wait till raining season...call carpenter to help yhu remove d zinc of his room and ceiling... Shikenan he can continue staying afterwards grin

Give a recovery noticce of 7 days, and bam!

There is a seemingly Big void as nobody takes any action since my Father passed (landlord) i.e, tenants civil enough do pay their rent to my eldest brother who lives far away but some like the tenants in question take advantage and do not like to pay...

Can I write a "Notice to Quit" and deliver it to him in person, or must I entrust a lawyer?

If I notify him about quitting the room, is he qualified for the 6 month the law prescribe...

I need tips on how to handle this situation...

Use the Rent tribunal. They can more effective for you, in this situation.

You have to engage the services of a trustworthy lawyer, also tell your brother about your decision, once he or she is sued, they will be be forced to pay or pack out, this is wickedness and a sin.

Not using a lawyer does not invalidate your quit notice.

Even if you use a lawyer,he can only write the letter on your behalf,not directly,because he does not have the power.

A lawyer is there for professional legal advice and defense in court.

If I was you....I will disconnect their light and water. Make the house extremely uncomfortable for them for a week before hiring boys to kick them out.

Don't go for a lawyer now, go to court and get a bailiff to serve them notice, lawyers don't have that right to serve directly of cause they can also serve through a bailiff which might be a bit expensive for you.

Just go to a magistrate court and ask for a bailiff, explain to him and he will guide you of the process and services which will cost you between 5k for the filing and all that before serving the notice with that same amount stated above.

If after that first notice they don't vacate, the bailiff will serve another seven days and if after that they still don't vacate, that is when a lawyer will come in because by this time, the bailiff will file and serve them a normal suit which will surmon them to appear before the court to explain why they refused to obey the quit notice from the court.

Your lawyer will then follow up your case from there. My dear you have nothing to lose cos at the end, they will pay all that they have consumed including the electricity bill, sanitation fee and all that they owe, just add them up through your lawyer.

Take a decision now otherwise they will cripple your economy like they did through their vote.

Nigerians are wicked! That's why I don't encourage people to build residential property for rent. Some won't pay their rent but are building a house!

How can a society people are inconsiderate make the required progress?

There is nothing like 6 months any more.There is a new law that say two weeks notice,after two weeks if he did not pack out. Get a good lawyer that will FasTrack it immediately through court.if the case is been called in court for 3 time and he or she did not appear. Court will give u arm police men to enable bring all his or her belongings to the court. All those thing will be release to him untill all ur owing rent are been paid by him and other court charges.

Never mixed business with familiarity. When it comes to money issues related to my income, even family knows I no send anybody talk less of others.


Seeing ur personality, you must be d nice guy type. Well, do this, annoy the hell out of him politely, anything & anywhere you see him, just ask about ur money, visit him constantly.


Where am based, I handle this sort of things for some people, I get to keep 10% of the rent, All the tenants pay on time, d grace period is only one week max!!, unless d owner of building pity you & increase. As for me, I just carry police to any idiot who tries to outsmart me, if you run & leave ur wife. Well, you will bail her for station after you pay me grin

Please don't take laws into your hands, because the law tilts more in favour of tenants. get a lawyer to Give him quit notice if his a yearly tenant If the tenant is on yearly payment, it is 6 months notice that u'll give him and it will start counting frm d day you served him d notice irrespective of how many months he has not paid.

Once the quit notice has been filed validly for 6 months, any day over that 6 months notice means the tenant is holding over that property illegally and he no longer becomes a tenant but a tenant at sufferance and from there onward you dont need to issue him a quit notice again but an OWNERS INTENTION TO RECOVER PREMISES in 7 DAYS And from there onwards the tenant practically has no defence legally when the matter will be filed at the rent tribunal nearest to you.

Tops with all the adjournment within 3 to 5 months the court balliffs will personally come to serve them to eject them of the premises compulsorily.

Let me give you a summary of what you should do .Serve him the statutory notices ie 7 days and one month,then file a suit for recovery of premises at the nearest magistrate court.

Once the case comes up tell the court you are handling the case yourself,enter witness box and tell the court what the man did and the order you are seeking from them.The bailiff will then enter the box and tell the court that he served the man but he didn't come .The court will then grant you the order you are seeking.You will take the judgement copy and go to the bailiff and pay them for policemen.

The policemen and the bailiffs will go to the man's house one early morning, break his house and pack all his properties to the court premises. I hope you learnt something today from this. Goodluck

The said property is alienated to his elder brother, that means, his elder brother is in the position to file or do whatever and not him. Remember the law of privity of contract.
