The sack was not done in accordance with the medical Residency Training Act.
For instance, even doctors whose departments got accreditation two years after they were employed, were given letters that six years had elapsed even when two of those years did not count.
Secondly, Residency Training in Nigeria is guided by the Residency Training Act of Nigeria which was signed into law by the president in 2017. The duration of Residency is based on time from eligibility to sit for exams and not an absolute duration.
Are you saying they can be retained for ever even if they don't pass their exams?
I don't see it as a sack at all.
Their contract has run its course and they need to create room for new residents

None of them has been allowed to sit for exams. Even those that would have had exams this month, if not for the coronavirus pandemic, were told to leave.
Some are not even eligible for exams yet.
None of them have written the part II exams, talk more of failing.
Moreover, according to the medical Residency act, a senior Resident has 18 months from when they are eligible for exams, to pass.
Strictly speaking that is not the employers business.
In this case they have been invited to apply for an extension which is fair but it is not an entitlement

Resident doctors are not employees per se They are essentially TRAINEES.
Trainees have a peculiar contract with budget for training,courses ,study leave etc
Infact it is not usual to offer an extension.
They are expected to pass their Fellowship exams during the duration of the contract and move on to create room for fresh intakes
If they have not passed their exams in the expected period they could consider Staff grade =Medical Officer roles
They should not deny training spaces to fresh residents

That said, it needs to be done according to the law. Residency training is not done in 6 years and only the national postgraduate medical college of Nigeria is empowered by law to exit a resident doctor from their training.
See the attached letter from the national postgraduate medical college of Nigeria to all CMDs of training institutions.

There is a fundamental point you are missing
It has to be paid for.
The law cannot oblige an employer to continue paying trainees without an exit strategy
The employer could be a private hospital though in Nigeria that is rare but all over the world once your residency or internship contract ends you can only beg for extension. It is not a right

The exam is written every six months and a junior resident has 12 months from the time of eligibility and the senior resident has 18 months from the time of eligibility to pass. Even when a senior resident passes, he/she has 6 months to spend with the training institution before leaving.
This is what the Residency Training Act says.
Residency is not regulated by individual hospitals. Read this letter from the NPMCN to all CMDs.

You obviously don't know what the Residency Training Act is all about. I'm not affected anyway, so no need to say I should look for another centre. Just telling you what the law says.
The NPMCN writes to training institutions every six months, recommending residents that are due for exit. The training institution cannot unilaterally exit a resident using their own local hospital rules. Residency is not a local affair.

This is not the case. They are 32 doctors cut across all the departments of the hospital.

You appear to misunderstand the letter you are posting
Residents are expected to pass exams in 8 years but it could be less.
That does not place ANY obligation whatsoever on employers.
Infact an employer could offer a four year contract without breaching any law

There is nothing malicious here. Residency program is a specialization training leading to them becoming consultants. And like every training, it is time based which every resident doctor is aware of. For then to still be in training means they have failed some aspects of the course. The training is not free and is paid for by the government. The management even graciously gave the option for extension which there should have quietly taken.

If you ask me, I would say these ones are been mischievous here.

There are two issues here
Residency and employment

Residency act is about training

Employment is a different legal framework
A residency act signed by Buhari can regulate training but not place any employment obligations on a state government

Federal government cannot legislate minimum wage for state governments

The state government is entitled to say we are offering you a 6 year contract which the doctors accepted long before Buhari was elected

The institution is not having regulations about training

Just offering a contract which could even be 1 year take it or leave it
As long as the Post graduate college approves
Did the College approve the contract at the onset?
There is no law saying training must take place in only one centre.

The 30 doctors allegedly sacked by the management of Benue State University Teaching Hospital (BSUTH), Makurdi displayed their sack letters earlier today Wednesday, as they called on the state Governor, Dr Samuel Ortom to intervene.

In a press briefing with newsmen, the President of the Association of Resident Doctors in the institution said about 32 of their members were sacked by the management. According
to her, the sack was not in accordance with the laws regulating Residency Training in Nigeria.

She dispelled the statement of the hospital management who said they had not domesticated the Residency Training law in the hospital, hence were took their actions based on the hospital policy.

The President said, "The Medical Residency Training Act (MRTA) was passed by the national assembly in 2017. A year later, it was signed into law by the President of the Federal Republic of Nigeria, Mohammadu Buhari.

"The Act regulates Residency Training in institutions anywhere in Nigeria and Benue State University Teaching Hospital is in Nigeria and ought to abide by the law".

She called on the Benue State Governor, Dr Samuel Ortom to intervene in order to avert crisis in the health sector of the state.

"We are, again, appealing to the amiable Executive Governor of Benue State, His Excellency Dr Samuel Ortom and all other well-meaning sons and daughters of Benue State to prevail on the management of Benue State University Teaching Hospital to obey the law, in order to avert a crisis in the health sector of the state."

Efforts to get access to the Chief Medical Director, Prof Terrumun Swende proved abortive. A source confirmed that he was in a closed meeting with the Governor over the matter and could not respond to calls and messages.

Your last sentence says a lot.
The vacancy for residency training in Nigeria is becoming something else.
Not passing the fellowship exams is also dependent on the examiners. Some of the
old examiners tend to look at medical exams with the analogue knowledge they used during their days. For one to have undergone training for 6 years in an accredited institution, signed and presented for an exam by the institution shows he/she has the adequate knowledge in that speciality. There is no need to expect one to turn into a professor during residency training before passing the exam.
The examiners should be lenient and focus their examination more on practical issues rather than theoretical. Because these days anybody can use Google for theory.

Benue my beloved state, why do we have a flair for the dramatic.
If what is happening in USA happens in Nigeria even vet Doctors will be employed by this Teaching Hospital, I'm disappointed but not surprised as this is coming from the watch of a young man who's first assignment when he resumed office was to disconnect the hospital from internet services little wonder he still doesn't have an idea what happening around the world, a man who doesn't see constant power supply as a priority.
