Help! My Business Name Is Already In Existence In Another Country, What Do I Do? by Lordpeckxy(m): 12:12am On Apr 27, 2020 |
Hello Nairalanders... Am creating an E-commerce web application of which I was to launch at the suppose end of this lockdown. The problem is that the business and domain name I desperately want to use, is already in existence in another country(taiwan to be specific). Am at a fix here, I don't know what to do, should I go ahead with the name or what? Its a little daunting as that is what I have envisioned my business to be. Is there anyway around it? Your suggestions and Enlightment is most appreciated. |

Lordpeckxy: Firstly, you need to know that the law establishing business in Taiwan and Nigeria differs which simply means you can REGISTER your business name here in Nigeria so far the business name is not registered as trademark in other part of the world. Secondly, you can not register same domain name when creating your website URL..NEVER! Will advice you add 'ng' to your domain name to differentiate yours e.g. www.(your domain name)ng.com OR at best you change your domain name. I hope this helps? 4 Likes |

Hennyola:@Lordpeckxy Most businesses tend to secure their likely domain names months/years even before the business takes off. I know you must have burned time and energy, structuring your business around the business name, but I strongly suggest you go back to the drawing board to brainstorm on a new name that will also fit into your company's goals, vision, mission, and ideas. Some have suggested adding the letter "s" or a word to the name you originally intended to use. Others have suggested adding "ng." All good suggestions BUT, if you have any slight feeling that this business will have an international footprint in future (near/distant), stick with .com and stay away from ng. For this same reason (international presence), I suggest you go for an entirely new business name, with matching domain name. But if you do not intend to have presence (online or offline) outside Nigeria, you can retain the exact business name and domain name (as long as you are not infringing on any trademark right), but go with the .ng extension, or like someone else said, add "ng" to the domain name. Good luck 4 Likes |

Why worry about a name, I honestly do not think that is so important as a startup. Provide service/product that everyone would love and obviously want. You will be shocked at how people will embrace the new name. Who would have imagined Konga or Jumia will be a household name. There are more important things in building a business than a name. 3 Likes |

You should envision your business if or when it becomes a big deal, or even a global phenomenon. Do you suppose having a business name and domain name that conflicts with another Taiwanese business is to your advantage? Let me help you, the answer is a resounding No. You need to pick a new name. In case of others who might be reading the thread and may have similar situation in the future, it is always good to design a truly unique business name from the scratch. Even then, from person experience I will advise you have at least two backup names, each of them with the same level of thoroughness in the design. |

Lordpeckxy:Depends on the reach of your expectations, it may not be necessary. But for someone that has Table.com, it may be wise to also get TheTable.com and Tables.com It helps prevent competitors from using something close to your name, and cause you to lose clients |
