During these Lock down I searched for all site to purchase a car until I found one on car45. I saw a corolla 2004 model bank type on their site, the car was a grade D car on their platform for 527,500naira. I called the agent in Charge of that inspection center in Port Harcourt she told me that their is lock down that I can't inspect the car if am not in port Harcourt, which I disagreed with and later agreed to pay for the car knowing with confidence that all cars go through a 200 point inspection bundled with a transparent transaction on Car45. I sent the money complete to their account the agent now assured me that she will park the car at their slot till the lock down is over, because I was happy to have bought a car, I called my friend whom I pleaded with to go and carry the car to his house until the lock down is over, just last week I decided to go and carry the car from Port Harcourt with my barrister friend on getting to my friends house the car I saw on picture was quite different from what I saw in real life, to cut it short the car was a dead car, the rocker panels have rusted both the doors, the papers where last renewed since 2011 with outdated plate number, I was so disappointed and cheated. I took it to their office straight away and quarrelled wit their agents who assured me that the will re sale it after several argument,that I should have insisted on inspection. now the same car45 are pricing me the car for 300k.My barristers is planning on taking them to court for gross misconduct and false Information. I have made several calls to their complaints center but no solution yet meanwhile I left the car and paper document for them in their office and the have being calling me to come and take the car before Tomorrows lock down begins in Ph plz any advice on what to do. Your mistake , even if it was Angel Micheal that sells car, you can't pay without seeing what you're paying for

Sorry I don't mean to be rude but why would you buy a car you didn't inspect your self or someone you can send there and there's are comment on car45 misconduct on nairaland and you still fall victim sorry bro.... You just have to accept your loss or take the car that way

Please ask your lawyer to file a complaint with the Consumer Protection Council. The body did a name change recently but it's still all about consumer protection.

The Council already has a file on Cars45 and action is about being taken. Please hasten to do it.

A mistake has been made. We are all humans and we make mistakes.

He needs an advice. The least you can do is offer him one.

What’s done is done.

@op sorry for your loss.

1. You can chose to institute an action against them in the Court.

Pros is that Legally you have a fairly solid claim - Misrepresentation is your best bet (Fraud has a higher threshold For dishonesty and you will most likely not succeed if you bring an action based on fraud).

Cons is that the legal process takes time in Nigeria. Your matter might still in court for the next 2 years - over how much, 200k? It may as well be costly in terms of finance, time and emotions.


2. File a complaint with the Consumer Protection Council, like someone alluded to abide. Pros, it’s less costly and in my opinion this is your best Bet. Downside is that this body is new and they may be unable to enforce their findings etc.

3. Sell the car back to them for 300k... Pros, you save and you can at least get part of your capital. Cons, you loose about 200k.

Write to them with your lawyers letter heading telling them of your plan to report them to Consumer Protection and also of your plan to sue them. They’ll surely invite you over.

The probability of losing this case is very high unless you have a very sound and respectable lawyer which may even cost you more than the whole transaction cost.

Most of these companies especially online platforms always have TnCs that exonerate them of wrongdoings from afar. How many of us care to read their TnCs?

Nigerians are one of the most treacherous beings on earth. So dishonest that even under your nose they will want to get you swindled. So these platforms always incorporate clauses in their TnCs to protect them from Nigerians dishonesty. You may chose to check it I am certain you will find one.

Now to those that recommended Consumer protection, well you never can say never, but the last case I filed with them is still pending after my calls and mails.. They called me once but no way forward since January 2017.

Nigerians are the strongest to be able to cope in a country where nothing is guaranteed, free for all environment!

The photos of cars you see online will not reveal everything to you.

There're lot more to check out in a car before buying, sound of the engine, absorbers, stability, handling, sound from the wheel/shaft/rings/joints, balance, rusts, electrical issues, gear, etc. You negotiate with these.

Even if the car is Grade A tokunbo, i will still inspect before making payment.

There're lot more to check out in a car before buying, sound of the engine, absorbers, stability, handling, sound from the wheel/shaft/rings/joints, balance, rusts, electrical issues, gear, etc. You negotiate with these.

I feel your pain bro. No one wants to be scammed of their hard earned cash. I think you should take them to court since u want that to be done. Most of ur actions aren't really wrong. I guess u made payment cos u trusted them and their reputation and they played you on that. Many online business are known for these acts. Taking them to court will be a good lesson and I hope you've learnt yours also.

Typical of most Nigerians we think we are very smart hence the guy have seen a very cheap car and want to quickly purchase it before another person overtake him and buy it, hence he threw caution to the wind and payed for a car he has not seen with his eyes
