ionsman:See... This has been flying around. The Court has no right to nullify an election The Supreme Court never dealt with the Bauchi issue in 1999. It was the Tribunal and later Appeal Court upheld. As at 1999, all Guber election issues ended at the Appeal Court. The decision to take out Lyon was a Supreme Court decision, only they can interprete. The Appeal Court decision isn't binding on the Supreme Court, instead its the other way around. |

Thats his own side of the story. There are always 3 sides (interpretations) to every legal issue. The one that favours you, the one that dosent, and what the law actually says. If/when the Apex court finally affirms the Tribunal's verdict, APC will know what to do. Diri is enjoying a stolen mandate, and it can be reclaimed, either via the main door, back door or window. |

ionsman:Adamu Muazu’s case under reference was an ELECTION PETITION, a Post-Election matter; so the Tribunal had the jurisdiction under section 140(2) Electoral Act (Supra) to NULLIFY the election and order a rerun. On the other hand, the BAYELSA State CASE (involving David Lyon’s Deputy) was a PRE-ELECTION case; the court had NO jurisdiction (in a pre-election matter) to nullify the entire election or to order a rerun. Only an ELECTION PETITION TRIBUNAL, properly constituted can nullify a general election or order a rerun in a general election. The regular court HAS NO such power. |
